Kim. I don't want to give them a call because I am happy paying back as much as I can. I didn't enter an IVA to save money, but to pay it back. I am, however curious as to the legalities of what you have entered into. All I can assume is that they have promised to re-claim any PPI, apply this to the debts, leaving you to cover the shortfall with your payments.

When i phone them i spoke to Andy he was very clear on wat they can do and very down to earth and easy to speak to, Ask for Andy ( i would so luv to meet he and say thank you ).

I think I'm with Foggy on this one. When my IVA is sorted I'll be sticking to it and trying to pay back as much as possible :-)
Today (15/09/11) I start my journey to a debt free future ~ happy days!

ist up to you wat you want to to at the end of the day but its but its just ppi its also unenforceable debt pre 2007 and unfair charges the same as martin lweis talks about and dominic littlewood dun a tv documentry on it to, but best of luck

I don't believe any of my debt is unenforceable ... I borrowed the money and I spent the money ... so I have to pay it back. As I said before I have no PPI to claim, any bank charges etc are a few quid only. Martin Lewis does make some good points, but is often "not quite" correct in his advice, as his research is a little biased toward the point he wants to make at the cost of accuracy (well, he is a journalist!).

To be honest, and with all due respect, I am also a little sceptical about not being able to get a straight answer and facts in this conversation, but, wish you all you wish for yourself. I hope it works for you.

Yeah - I'm ok with my IVA. Bankruptcy would have been the easiest option for me. But we spent it so we are happy to repay as much as we can.

Too many ambulance chasers in this world in my opinion. We have been able to write off a lot of our debts (due to my ill health affecting our imcome) and that is down to the good work our IP has managed to do.

If it's worked for you Kim that's great but people should be warned that it won't work for everyone and could cost them more.

Also - the uneforcable debt item - only means that they cant take you to court - but it does not prevent them from adding charges to the account or defaults to credit report.

Would like to see Kim credit report - to see if it was all worth it !!

I agree with Foggy on this one. Although I took out my loans and credit cards prior to 2007 they are enforceable simply for the fact that I borrowed the money and spent it. I had every intention of repaying it when I borrowed it - if I hadn't it would have been fraud.

I'd be interested to hear the answer to Foggy's question but I'm presuming we won't be getting an answer to that.

Same Here skippy - apart from a moral argument. - You borrow /take money and then try to get out of paying it back because of some "loophole" does not sit right with me !!!

I know I ended up going BR, but I would have been much happier to have repaid some of the money I borrowed (willingly) but it wasn't to be.

Skippy, you need to take the course that best suits you ... an unworkable IVA ( for whatever reason) is as good as a chocolate teapot. Different ointments for different ills.

Exactly. There are many legitimate debt solutions out there and it's just a case of finding the right one. I wanted the IVA to work, but it wasn't to be and with events in the last few years it would have failed anyway!

The forum will never condone trying to wriggle out of paying so called 'unenforceable' debts. I was the same - took the money out with the intention of repaying it and will pay back as much as I can.

As to PPI, I've never had it at all and bank charges were all included in the IVA.
