my husband gettin an iva however it nothing to do with me but they are using my benefit dla as part of his income is this right

It will only be being taken into account to make sure you are both paying your fair share to the household.

Sorry also mean to say if you pay certain expenses from it for your disability it can all be included in your husbands income and expenditure so it can be off set

Hello sh2468,

As you are married your husbands IVA proposal will show a household income and expenditure which should include any income you are getting, DLA payments are included in this.

Skint has already mentioned but although the IVA proposal has nothing to do with you, the I.P will still need to make sure that you are paying your fair share of bills.

Hi we have just had our first review, howerver we was unaware that the DLA my wife recieves should be fully refunded as an allowance. got hold of the DWP and got this reply to an Email, I quote,.

Is DLA suposed to be included as an income for IVA?

Gerneraly speaking it should be up to the client to decide whether they want to use some or all of this income towards debt repayments.

A standard stratagy is to include it in your budget as an income so you are being open and honest. Then deduct the whole amount out again under something like 'DLA costs' so they are 'allowed' to take it into account but you can refuse....... un quote.

however our IP dose not accept this and is writing to the DWP themselves.
