This really is not acceptable. I would seriously now consider starting the complaints procedure. It is your right for a proposal to be put forward.

Take a look on their website and don't take any more c**p with trying to adjust disposable income and get the f&f presented.

Thanks Struzzo39 and kazzafunk. I am at the point when I feel a complaint is going to be my only answer but then I'm worried that they won't assist us with putting the proposal forward or will present it in such a way that the creditors will reject it.

This whole sorry saga is becoming energy sapping now. We tried to be pro-active and told them about it in March when the issue first started and tried to get things to them but I just don't understand how they can pluck a salary figure out of thin air that is completely different to that supplied by the employer - beats me!!!
F&F approved May 13 - just awaiting Completion Certificate - moving to a new Debt Free life !!

You have much more patience than me, I would stick to your guns and be very clear to them, give them you I&E as you know it and what your disposable income figure is in response to anything from them that differs from this, keep responding with the same figures and tell them to put this forward and that you do not accept their figures, ask them to prove to you where they are getting their differing figures from

Insist on speaking to the IP, to avoid being passed from pillar to post yet again, and e-mail them directly to ensure that they have recorded your dissatisfaction in the meantime.

Thanks for the replies.
I'm at work for the rest of the week now so won't be able to try and make contact again so I have sent an email direct to the IP.

They do not appear to be able to understand that my husband is not on a static salary until November as they are paying partial protection payments to him. They just keep changing the goal posts on allowances and creating salary figures themselves that bear no resemblance to the figures quoted by the employer.

In an effort to give us some space to get everything in order and liaise with the IP, we have put forward a proposal of making nominal payments in September and October so that we can then receive his November wageslip (which will be on his new basic salary only) and then they cannot challenge the employer's figures. The allowances we now have emailed confirmation of what has been agreed so once they have been deducted from the new salary there can be no doubt about any disposable income that may be left.

We are not trying to get out of our obligations and have paid a sizeable chunk into the IVA but now feel every last inch has to be bled from us before any variation will be considered!!!

Will let you know how we get on.

Well a result of sorts today. Having emailed our IP last night with a proposal, I received an email back from him this morning, however, it only stated his colleague would be ringing me!!

Anyway, they have agreed to our proposal of making nominal payments until December (under their discretion) at which time my husband's salary will have changed to his new rate without any protection. That way, we will be able to produce a payslip to back up the figures HR/Finance are quoting. A decision will then be taken as to whether to apply for a variation to reduce the payments or apply for a F&F. Not really what we wanted at this stage but at least we have some breathing space!!

Well at least he is now on the case and aware of your issues - most of us delegate a lot of the tasks to our staff as a rule.

Sounds like a sensible plan in my opinion, so I would say a good result for now.

We are happy with the situation for the time being - it is difficult with the salary change for the few months he is on reducing protection but at least this way we can produce the payslip when he gets on a static salary to evidence what HR/Finance are saying and then the IP will have to accept that.

I'm sure I'll be back with updates on this in December!!

Thanks mazbrown. This seemed the most sensible solution for now as IVA company were working out an estimated net salary that was nowhere near what the HR/Finance payroll system was estimating and had put in writing for the IVA company. At least this way, we can wait till we get the actual figure and take it from there.
