Our IP has finally got back to us after receiving our paper work agreeing to the reduced payments that they have proposed due to the cost of living rises. They are looking at our payments being reduced by £140.00 per month.

Our IP are asking our creditore to either agree to the reduced payments or that they choose for the arrangements are failed. they have set a date for 3rd September 2008.

we are hoping that our creditors agree to to the reduced payments as we really don't want to go BR.

what happens next if they fail the arrangements?

I'm feeling so stressed from the pressures of what is happing with the IVA and my children pestering me for this that and the other and the tempers they throw from us saying no all the time. My youngest whos 10 said the other day "Mum why do we never have a holiday, why can't we have a holiday like everyone else?" It makes my heart break

My eldest son is going up to secondary school this year and already his school uniform has cost us £109.00 just for some of his pe kit as he can only wear the pe kit that the school provide. i'm looking at a total of £200 - £300 for his unifrom alone and i have another boy to kit out for new school gear.

I also contacted the Tax credits to try to claim back the childcare I payout for during school hoildays. They told me I can only claim if they go for more the 4 consecutive weeks, meaning I can only claim for the 6 week school holidays (ther are 14 weeks in holidays in the school year)and I have one week off and so does my husband to look after the kids in the six weeks, so I can't claim. what a big joke the tax credits are, they've already stuffed us and stopped our payments for so called overpayments and we had no payments from them for over a year.

Fingers crossed that your variation meeting goes ok smile or cry.

If the worst came to the worst and they failed your IVA, you could always look at a Debt Management Plan rather than leaping straight into bankruptcy.

Don't know what you do or who you work for but I have a benevolent society from work that I can ask for money for things I can't pay for or one time they sent me £400 towards Christmas. I can also ask my union if they can help. There are other funds/societies and you can find them in the reference section of the library or you could try and search on line. Just write a good letter telling them of your situation - I told mine that I was being responsible and doing an IVA but that the stress of everything was making me ill and any help they could give me would be good. Tell them your story and tell them what its for - even for a break and send the same letter to anywhere you can find that accepts "pleas for help" - you never know you might get something.

Thank you for your kind words of advice, I'll have look in the library and I'll have a chat with the school when they start up again to see if there is anything they can help with.

We tried a DMP before taking on the IVA, sadly this didn't work for us as the main creditor decided not to accept the payments after a year. This didn't help my health.

If your creditors reject your new offer then I would consider bankruptcy.You have done all that you can and it is not worth damaging your health over this.
Do you have any equity in your property ? And can you afford the £1400 per month for your mortgage ?

Sadly we don't own our own home, and when we informed Synergi last year that our rent was going up they didn't make the changes, so on this years review it's been added on. I've not had an appology from them about their mistakes. They haven't even offered us the money back, yet they say we earned an extra grand in 6 months (don't know how they come up with that as our pay rise only came to £9 a week joint)I'm still waiting for a break down of how they work this out and have asked 4 times for this.

I asked Synergi today if they knew what our chances were of the creditors accepting the reduced payments,but they couldn't answer.

we're in this situation through loss of work on my husbands side and my husbands ill health 5 years ago and the banks screwed us and wouldn't pay the loan protection even though it was in a joint name. they said as i was the first person named that they would't accept the claim, yet when i phoned them about they said they would. Two faced !!! we even appealed but they still wouldn't budge.

family and health do come first, but i'm finding i'm slipping back into depression and finding it hard to grip the edge and climb out of it. synergi basically didn't believe our moderate increase in cost of living (we increased food by £40 per month) is that too much to ask?

Do these guys live in the real world. Surely they shop, fill their cars us and use gas and electricity - and everyone knows that the cost of living is increasing at an alarming rate.

We have finally received a break down of earnings from our IP, as we thought, they are showing that we have earned the extra when there are five week months, but surely these should of been taken into consideration when they calculated our earnings in the first place so that they averaged out?

So because of the five week months, we are being asked to pay 50% of the extra earnings that we haven't earned

What we feel about this company can't be said on here

Tell them they should be working out your income on a 13 week basis. This will deal with fluctuations in four and five week months.

Thank you ever so much for your advice on this. I shall e-mail them tonight and add in your advice. We had this problem with them back in Sept 07 and we also questioned them why were they not carrying over the minus amount each month and their excuse was that a junior admin clerk carried out the review.

Sending out positive thoughts and a hug back to you too.

I remember those awful days of struggling to kit out four children in school uniform only too well ... indeed it is how most of my debt built up.

In answer to Andy's post you reply that "sadly" you do not own your own home ... but this could perhaps be a blessing by providing you with the fresh start offered by bankruptcy.

As everyone else has said you must not let your health suffer too much.

Hi Debbie, you are so right when you say we are blessed in not owning our own home in our current situation, and I really do feel for those who face loosing their homes. Some friends of ours are facing it and know our situation. On the other hand I have been judged and am still judged for not owning my own home and living in a council house, so I don't have anything to do with those types of people, as I say never judge a book by it's cover.

I am trying not to let my health suffer and have been offered staff support, which I will take and it will be nice to talk to someone. I also feel much better everytime I have been on this site which is being a help especially as most of the family know nothing about our situation.

I tried getting some empathy from my dad and all he said was your not the only one suffering.... so much for families
