my ip just mentioned that they have to give 28 days notice to the non claimed creditors providing them the final divident details. if they dont respond then they will have to give another 2 weeks notice. i now have to wait for 6 weeks to get the completion certificate to inform the credit ref agencies.

Strange that this important step - ie to confirm the level of claims and thus confirm the amount of dividend to be finally offered - was not completed at an earlier stage and certainly prior to the variation report being pushed out!

melanie, mr skint was told that his creditors were given 28 days to submit claims. The 28 days have now passed and he has been told that the closure team are taking steps to see if they can get them to make a claim over the phone.
The plus side is, they say theres very limited time left for them to make this claim now or be excluded from the dividend.
She also told him that typically it takes 16 weeks before a certificate is sent out.
Seems mad really when we hear of other people getting their certificate so fast.

It is a nonsense. The creditor claims should have been well agreed before they even put the variation meeting together. The principles in Rule 11.2 of the Insolvency Rules 1986 can also be applied to IVAs which gives creditors 21 days to submit their claims, or else they will be excluded for dividend purposes.

i just logged back and they need to get the claim for non voted creditors. based on my case they need to give 21 days and then another 7 days to finalise the dividents
