My wife had IVA for 5 yrs finishing in Sept 2011
Had a phone call this weel saying she is entitles to a VAT refund. Confirmed this with DFD.
Has anyone ever had any money back and if so how much?
She paid in £300 per month.
Just curious. Dont want to get hopes up.[:)]

I believe DFD's stance is once an IVA is finished, then any reclaimed monies will go to the claimant be it PPI or VAT.

A recent post suggested that when a PPI claim had been made that was directed to the FOS they directed the payment to go to the claimant.

Some say that it was an asset at the time of the IVA therefore it belongs to the creditor but some say that once the last payment noted on public record as full and final that's it contract terminated

I’m going to have a guess, that once the final payment has been made if a subsequent claim is successful then from a legal stand point and the one the FOS may use is, “it was not foreseeable” therefore the claimant get the money?

You’ll have to check the facts, but it’s the only sense I can make of it, be nice if DFD would tell it as it is? or any other clever bunny come to that?

A recent post appears to suggest it's a claims company of the PPI type, this is second post I have seen this week on the same subject

A independent company checking peoples names and address. Said cheque would be sent in 5-6 weeks. DFD confirmed this.

What I dont understand is why they cant give me more info. They must know how its calculated!

I received a similar call from a firm acting on behalf of DFD a few weeks ago just checking my contact details re same issue of VAT. Was surprised to hear anything as Imade last payment to my IVA which was successfuly completed in Nov 2011.

Last Thursday evening I received a cheque in the post with a brief letter from DFD saying due to court ruling in their favour re VAT issue here is a refund cheque for you. I got a cheque for £382! Considering I wasn't expecting anything on this I was really pleased!

I was paying in approx £400 per month for five years and last payment was arounf Oct/Nov 2011. Sounds similar to your wife's payment history so who knows, maybe a cheque will be sent to her soon too but don't hold me to that. I think the VAT refund issue is assessed on a case by case basis.
Last payment made on 1st Nov 2011. Happy to be debt free!

Did you repay your creditors in full beresford, as a matter of interest?

Hmm is it worth a phonecall to DFD to see if we are due anything back on the VAT side of things....we paid all back and ended March 2011???

I cannot see how you are entitled to receive anything back from the VAT reclaim if your debts were not repaid in full beresford. Any recovery should have been paid to creditors and not to yourself - even if your case has been closed.

My thoughts exactly Melanie but I am not going to return the cheque to DFD. It is what it is. In the grand scheme of things it is not a huge windfall. Maybe with such a modest amount it is not in the creditors best interests to split and allocate these monies to accounts which are in theory now closed - just a thought...
