Hi all well this is been getting stupid from the start to end, Basically i have finished my IVA the court dates was october 10 but because they did not start they payment until it finished March 11, anyway i have been asking where my completion paperwork is and was told they were just finishing it and it would be with me in a week, this was end of May.

Had no joy so rang them again end of July, they said dont worry it will be with you in a week, still nothing.

i have just rang them to be told they can not do anything because another company IP is disputing VAT on fees with HM costoms? and everyones is now on hold. They have said to us they are unsure how long this will be but can send a letter? can anyone shed any light on this as it seems i am getting passed from piller to post..

I want this, as i wanted to start getting ready to rebuild my life in October that being the 6 year point. History etc..and if when i do my credit check come october i have the correct paper work to send to the credit ref agencys to clear them etc..

Hi and welcome to the forum. Well done on completing your IVA and although I do know completion certificates can take a while to be produced, I don't know too much so what we'll do is bump this back up for an expert. Which company were you with for your IVA? x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi the IVA was with Unity then moved to Tenon but the Practitioner was the same throughout.

I am also with Tenon and finished paying my IVA in April. I have also been told that they can not complete the IVA because they are reclaiming the VAT on there fees and can not give a time frame for this to be completed.

Maybe Melanie or one of the other IP's will be able to explain this as it's way above me I'm afraid but do hang in - I'm sure someone can offer some advice. x

I have just had this response from Tenon and am actually quite upset. The fact that they didnt even contact me to tell me this was going on is just wrong.

I write further to your request for a certificate of closure.



A recent decision by a tax tribunal, which did not involve your IVA but which is likely to affect all IVAs in the UK, means that it appears that VAT should not have been chargeable in respect of the Nominee’s and Supervisor’s fees. As a result of this, my firm is making enquiries into whether a refund of VAT may be claimed. The position has not yet been confirmed but it seems probable that any refund would be paid into your IVA.


Whilst these enquiries are ongoing, there will be a delay in terminating your arrangement. At present I cannot give you a timescale for how long this would be. Your IVA will simply remain open to collect and disburse any VAT refund due.

Given the circumstances, should you require a further letter from me to be presented to your creditors or a third party, please do not hesitate to contact me.



I have asked if this will effect how long the IVA stays on my credit rating and am waiting for them to respond. I have done my bit I understand the creditors will want their money back, but I want my life back :-(

This is the same as me then, near on 6 years and they have not sorted it, this just means its going to drag on more and more now, will i ever be fre.....

Other posters are receiving completion certificates (from other companies) but it states in the letter is likely to affect all IVA's in the UK?

Hopefully someone will be along soon who can help. x

Sorry not sure what happened at the end of my cut and paste there!

Yeah be six years before I know it, completed in Feb this year. Problem is I am pregnant and on my own I need to clear up my credit rating, in case I have any money emergencies with little one.

:-(

That's not good for either of you.

The IVA should drop off your record anyway after six years so I don't think you have anything to worry about there.

You won't be able to sort out your credit record until you can prove to any creditors who have defaulted you post IVA acceptance that you have completed. For this you will need the letter.

You'll remain on the insolvency register as well.

Hopefully one of the experts can come on and comment on this.

Response from Tenon.

I can confirm that the IVA will appear on your credit file for 6 years from the date that the IVA was approved (7 March 2006).



A letter has been drafted for you to present to any creditor or third party confirming that you have complied with the terms of your Arrangement. This is currently in review with a manager but I will ensure that this is forwarded to you in due course.

At least they did get back to you - I hope it doesn't take them too long to 'review' the letter - how hard can that be? Hopefully it will be with you soon and you can always try and see if any creditor that needs it will accept that letter.
