Hi Mike,
I know that's a high APR but he seems to have no choice. American Express have just adjourned a bankruptcy order at the courts my husband had to pay them £3k as a goodwill gesture, and show them the documentation re the potential solution, if they don't get the money they will make him bankrupt. Where else can we go? Grosvenor have assured my husband that Swift are the only option. My husband earns £120k a year (ridiculous isn't it). He can afford repayments but can't get another lender. The idea is that when his credit is repaired he can then get a second mortgage with a more reputable lender. The £194k he is borrowing would pay off all mortgage arrears and his debts. Monthly payment is £2k our existing mortgage payments are £1900 he comes out wiith £6k a month and I get £1600 a month. I hope for he learns from this, going forward I will be scrutinising his bank accounts monthly.

Hi Liedto
Are you sure that this is the route that you want to go down after all that's happened ?
You are using some of your equity to pay off his unsecured debts. Are you sure that he will stick to the repayments?Do you know what he has been spending his money on rather than repaying his debts and mortgage ?

Those are very good points Andy. From my point of view I don't know if I would want to help Dave in those circumstances. As much as I love him, it would have ruined the trust I had in him. I would also worry that by using my equity to bail him out he wouldn't learn and the same thing could happen again.

That said Liedto, I hope that whatever you decide works out for you, and your husband learns his lesson.

Around February of this year my world fell apart. In the space of a few days I found that there were £10k mortgage arrears on our property, which was in joint names. My husband had debts over £150k. I knew nothing of any of this as he had been hiding the post from me and when he was working away asking friends to hide post from me.
I (not my husband) spent hours and days and weeks on the internet just searching for ideas, putting in keywords. Reading up on things.
The first solution, I thought would be an IVA and months were wasted exploring this to then be told that we had too much equity in our home for this to be an option. Understandable if only we had known.
Second option - a mortgage with an extortionate APR with a company who seemed to share their offices with a variety of other companies (I discovered after searching on the internet). My husband met with the chaps signed the papers and then asked me to sign. I didn’t sign, thank god. All that took months. Once the firm helping us learned that I wouldn’t sign all went quiet. Once again I looked around for other alternatives.
Over the past 9 or so weeks another company had been working on possible solutions. But then we heard nothing from then for a few weeks.
On Saturday my husband went out so I decided to snoop to see what post he may have recently hidden from me. I found a letter from the count courts regarding a bankruptcy hearing on the 9 October. The letter was dated the end of August. Once again I knew nothing about this. After I finished ripping the sorry sack of s*** apart I TOLD him to get his act together and find out where we were at with the company who had gone quiet. They came back to us with the swift option.
I posted the latest news on this forum on Monday 8 October. On the 9 October I saw the post from Mike at Leybridge and almost dismissed it. When my husband returned from court I asked him to give Mike a ring he did at about 12ish. Last night Jamie from Leybridge called to say we did have another option at a MUCH better APR. Today it’s almost sorted just the papers to sign and the passports to verify.
I can’t explain how much relief I feel. But the amount of time it took for Jamie to sort this was astounding. I can’t explain how I feel as I’m not sure myself. I feel in shock that at long last after months of worry and really getting nowhere fast it’s almost over. Why have the other companies we contacted taken months and months to come up with such poor options?
Jamie, Mike, thank you, thank you, thank you.
By the way. For everyone who feels I may be a sandwich short of a picnic for staying with my deceitful, dishonest, useless, lying ****bag of a husband. Rest assured my time will come….

Liedto, please don't think that I think you're a sandwich short of a picnic! I like your fighting talk at the end of your post, and remember, revenge is a dish best served cold! Good luck for the future, and I really hope your husband has learnt his lesson and appreciates everything you have done for him x

Your husband is a lot luckier than he perhaps realises. I hope this is a lesson to him and i hope hes more honest with you in the future.
Nobody deserves to be treated the way you have been. Respect costs nothing so surely he can afford that.
Best of luck to you and i genuinely hope you sort things out.

No worries, I didn't mean my message to anyone specifially. If I was reading my story I would think the person a little potty for continuing. What I did forget to mention is that I do believe that this whole debacle has frightened him. I won't ever trust him again and I will continue to snoop through his things when he's out. We've made an appointment with the solicitor Friday to sign forms but also to see if anything can be drawn up to protect me in the future, one thing is him acknowledging this is his debt and not mine, maybe I can maybe I can't we'll see. Thanks for your support it means so much. xx

Hi Liedto

I was moved when I read your post. When one is lucky enough to have a good marriage and a life partner you can trust completely it is easy to forget that not everyone is that lucky. But when I met my present wife 9 years ago I was bankrupt and had a failed marriage behind me as well. Together we rebuilt, built a successful business, and a wonderful marriage. You will meet someone else, someone you deserve, who will cherish you and be a real partner.

Meantime, keep posting, everyone on here is here for you.

Please do seek independent legal advice before you agree to sign anything. your husband has forfeited the right to ask for blind support.
