ok so this is wat i done so far, i contated cccs, and after sedning info they requested they recomened bankrupy as i said this is NOt and option, so then got the call back from bright oak, the company mel recomemded, and by gosh andrew there was so nice.i said i wasnt sure what we were going to do, and had had advice of 2 companys that didnt seemt o help i explained the situation, that when we work it out we have very little to offer creditors, he said that creditors may accepts 1% of what we owe there fore we be pay 201 per mth, plus there fees of 15% so i get that to 231???? per mth, i sent n email to bright oak with everything we pay in n out n what we owe n ihoping they contact me. cccs have arrange a phone appt but no to friday, thats too far away. If no i gets in touch by end of today, we are going to go it our selfs and hope for the best print the letters off we got from cccs, and offer them 1% of the debt we owe..... can any 1 advice me. is this the rite way to go if no1 is able to arrange a dmp for us.... do u think offering 1% is ok as a temp arrangement?, i men once we hve the utilitys up to date and the c tax arrear they can have more, so what do you think??/// im hopoing that if we dont get any 1 to take us on for a dmp, no 1 seem to want to, that if we go for it ourself and ask them to do this for a 6mth to start see how thing go..... imjust fed up we want help and it seem no 1 wants to help. i mean what more can we do.....lisax

Glad to hear you contacted brightoak hopefully they will help I think you would be better with a company dealing with a dmp for you as it would take the pressure off you a bit and that is what you need.Thats a good idea get up to date with the utilities etc and then have more to pay to the creditors.

we are going ahead and going to try a dmp with bright oak, thank you melanie, Andrew put my mind at rest so much, hope it dont take to long, its nice to no tha some 1 is there to ofer help , i didnt think i was gona get...... saying that if this fails im not sure where to turn......i mean offering 1% mean black horse get 60 per mth, they wanted 80 b4 we went for iva but 60 better than nothing that they getting at min...... so here we go again thanks to every 1 on here lisax

lisa just to warn you about black horse when i entered a dmp they continually harrassed me to pay more to them outside the DMP, i never gave into them, they stick to the £80 per month and won't budge and say they won't accept the DMP, take no notice, i just asked them if they would be returning the monthly payments then that i was paying already, they didn't like that, just to warn you what they are like, hope it all goes well for you.

Really glad you finaly have some positive news,and i wouldnt worry about Black horse im sure Bright oak will deal with them as and when the need arises,if you do get any hassle you can just pass them on to them,thats why its such a good idea to go through a company let them take the pressure so that you can concentrate on your family.

oh great its the dredid Black horse again,,,,,, so when you did a dmp, and inc black horse, do you manage a dmp for so long and did they accpet the payments then im thinking at 1% they be getting about 60 but yeah they said to us they wanted 80.....
and they said if we didnt go ahead with them on 80 be iva there were going to get acourtpetition to get our ceretificate of earnings.....
but if this happend and they went to court could we not say to sourt we in a dmp???? and are offering wat we can afford too??? oh gosh im so worryed now.......[:(]lisa

Hi Lisa
It is highly likely that they would get less in a court as no court will expect you to pay more than you can afford and the court will be able to see that you have done your best to sort it out, and that they have been difficult. Try not to worry let brightoak sort it out.

Lisa, the courts will only make you pay what you can afford. And anyway, like Kerri said, it may take sometime for BH to accept things but eventually they most probably will if you stick to your guns.

Although they will tell you otherwise, they should talk to your DMP people not you as it is clearly set in OFT guidlines that if you have a third party dealing with your debt problems they must address them not you. You could always put this in writing to them. They are possibly breaking OFT debt collection guidlines on points 2.8c,d,&e if they bypass your DMP company. Let them know you are aware of this document and its contents. The full document is available at :

lisa BH try every trick in the book they are a pain in the but, but be firm with them, when they tried to make me pay outside the DMP i said no as i can't seem to be being preferential to you, the other creditors would not like it and they have accepted they DMP, i never paid them anything for nearly 6 months and still now after BR get letters off them saying they will take legal action, they are not very fast in enforcing their scare tactics. don't worry you are doing the best you can, one lady from BH kept saying to me they were taking me to court and i said ok but nothing will have changed on my I +E and the judge will see i am offering my best, oh no she said they will go with us,so i said more like me and they may say i don't have to pay the x amount already offered, i had to laugh they can't have what i ain't got and ended the call

an update..........
we are going ahead and trying to arrange a dmp via the fab company mel recomended.....
have given them everythingt hey need and are offering just under 200 per mth,this is about 1% of wat we owe to each company just have to hope and pray they accept, hmm i see another BH sarga on the cards. this is my final chance... i been told by husband that if this fails too, and we get ina worse state hes off as he cant cope any more... great eh...hope every 1 ok, just got to hope and pray they accept i mean they geting there moeny back in the long run arent they......lisax
