Mmm its all so confusing,

We are not entitled to them now but we have had this arrangement to pay off the debt for a while, so yes, it was BEFORE bankruptcy.

I have rung the number, no-one seems to know for sure, I am currently waiting for a Manager to ring me back!

The last part is interesting about them being added to the bankruptcy and treated as any other creditor! Ooops, I have been paying them still since bankruptcy as I did not know any better, our OR (assistant?) is not helpful or knowledgeable at all and we really are not sure of what we should be doing!

did you include them in your BR petition? my case has now been forwarded to the inland revenue and they will let me no by post what the outcome is. if you were in agreement to pay this back before BR it will stand until discharge then the rest of the amount outstanding should be wiaved on discharge, thats when you phone them back and get them to re look at your account, all the information is on the insolvency site and the tax credit site found it today myself as i was interested to know what happens now, of course will let you know as soon as i hear off the inland revenue.

hello there,

I thought I would let you know we are the opposite to the above, the tax credits owed us £800 from last year and because this was before I went BR and the OR took the whole lot out of my account last week, It's been there since July and I understand why they wanted it but it's very frustrating when you keep the tax credits upto date with income etc and then suddenly a lump sum appears. If they had paid this monthly correctly last year when we needed that £800 then it wouldn't have been taken from us this year. I understand we are only to blame for being in this situation but when the tax credits don't do things right it does frustrate!!!

rachel what a blow!! you are the first person i have heard of actually being owed too!! and then poor you getting it took off you, justs shows it works both ways in BR.

I know! just my luck eh, but the thing is I know they are overpaying us this year, I have written to tell them, so guess what in April I am sure they will suddenly want this years money back and then we receive no payments again!

very frustrating!!

telephone them and get it sorted and ask that they put it all in writing to you confirming you are not being overpaid, they done this to me so much before my BR and it was all mainly because of child care costs and nursery fees at the change of ages and me withdrawing youngest to go to main stream school, they messed up so much they halved the payments upped the payments and i was constantly on the phone, then i was told i owe £5.5k, for over a 3 yr period, yet it had never come to light in the previous 2 when they had all actual figures.

Tax Credits are one of the many thorns in my side. Since Jan this year they have sent four letters saying that they are stopping payments because they have made a mistake and after all the bills and IVA were paid it left me with £30 to feed a family of four for a month. I spoke to Tax Credits who were not interested in the slightest and our IP told us that if we were unsucessful in our renumeration meeting (bearing in mind that it was the only one we have ever requested) it would end in BR, which, with a young family I didn't want. Even now I can't rely on Tax Credits paying the right amount cos every few weeks we get another letter saying that due to a miscalculation they are dropping our award £35 etc.

What it comes down to is that the staff at these places are incompetant and are not held accountable for their mistakes and as a result the mistakes are continually made. If I balls'd up that much in my job I'd be out. However, apparently its OK to make lives like ours a living hell.

Its very hard living off £30 for a month. I think these people should be forced to do it. Maybe next time they might actually give a s**t!
