It would be noted by the Official Receiver and technically could result in you getting a Bankruptcy Restrctions Undertaking or Order - but for the sum of money involved this may not be necessary.

That's what we are all here for Dee ... we all gain AND give on this Forum ... no doubt your own experiences will also mean that you will become a help to others in the future.

Have you stopped paying your creditors yet? You could use this money for your bankruptcy fees. Paul Johns who posts on the Forum as 'Reviva' has a term 'putting your ducks in a row' and I always think that this is a lovely way of putting it ... you need to have a plan of action and a timetable.

Hi

Just about to stop paying the creditors. We have to because we only have my wages at the end of the month as my hubby is weekly paid and he is redundant next week. I was going to use my wages for food council tax car insurance and fuel to work.

We think we have a rental set up for 1st of month, we were going to take the bankruptcy forms in next week after our appointment with the CAB and before we move to a rental. We were really hoping to do it from our current address and that the landlord would not find out. I think I am starting to panic again.

Melanie ... would the same apply if Dee were to pay for the food, council tax etc. on the credit card ... and kept the cash for the BR fees? I suspect it would.

Don't panic Dee ... there WILL be a solution. You're doing great.

The use of ongoing credit, after recognising personal insolvency, for whatever reason is always frowned upon Debbie.

Hi there.
Tell me, why have you not been down to the Local Authority Homeless Team to discuss your options re your housing?

You would be advised to take free advice from Shelter (the Housing Advice Charity) before you do anything re private rental. I suspect that any local authority would be pushing it if they tried to claim you were intentionally homeless - you husband has had no control over his redundancy situation.

You've advised that your daughter still lives at home and that she is just 17. There may be a number of routes that you can take, but for instance, she would be able to make a homeless application in her own right (normally LA insist 28 days from leaving the house) and as her parents it would be reasonable to expect you to reside with her.

Failing that,she is in full time education so I would ask Shelter if she therefore constitutes your housing status under 'priority need'.
I'd check it out - it won't cost you anything. They have a website.

Just to add, I know it is wrong but we used our £1000 overdraft to pay for the bankruptcy, the OR never mentioned it!

We were desparate and could see no other way of getting the fees together anytime soon!

Thanks everyone for all your good wishes and advice.

I feel a bit calmer today. We have been offered a rental home through a friend of ours. I cannot beleive our luck. He knows we are about to go bankrupt and hubby is redundant next week. He is just finishing building it, it will be done by xmas. We are going to brave it out in our house until then if we can - we will not have missed a mortgage payment until after 1st October - so hopefully we will be ok here until xmas.

I have appointment with CAB on Monday to fill in the bankruptcy forms and will take them down on Tuesday. Does anyone know can we keep paying gas, electric etc because if we are not paying credit cards and morgage we can afford to keep paying utilities and food.

A brand, new house as well ... all conducive to a fresh start for you. I am sure that it would be fine to pay your utilities over your creditors.

I went to collect the forms today!

I had a shock it is £495 each - I thought it was £350 for one person and £495 for Joint.
