i have an iva then i became redundent i got in touch with them they said next step was bankruptsy and just do nothing till u hear from them.this was a year ago then just recently my father recieved a letter his address but my name from eversheds max recovery i was wondering is this linked?

Good morning and welcome to the forum.

I'm no expert but are you saying you have made no payments to your IVA for a year on your IP's advice or did your IP suggest payment breaks and advise your creditors you were made redundant?

Have you ever been linked at your dad's address? If so Eversheds could be trying to trace you - have you had any letters to your home address in the past year?

I would contact your IP asap to try and resolve the situation. If the IVA has failed, which is possible if you haven't or can't make the agreed payments. Then BR or DMP maybe options. Do you own your own house?

Sorry for all the questions, but the more details you can post the more help an expert will be able to give you. Just bear in mind this is only advice and the best person to speak to is your IP.

Your creditors will be looking to get their money back again by now.
Max Recovery are a company that buy "bad debt" so i can can only assume that one of your creditors has sold their debt on.

I would imagine that your IVA will have failed by now, but check on the Insolvency Register to see if your name is still on there.

thanks for the replys im not on the insolvency register so what does this mean and i dont own or have anything in my name i am a single parent of 3 and when i started working again i got in back touch with my iva and they said i still would not be able to afford it i didnt no what else i could do

hi again yes when a told my ip i was made redundant she said when i stop the payments i might or might not hear anything else but the next step would be bankrupsy but with any luck i wont hear nothing . i am getting in touch with my ip and ever sheds to find out if it is my debt and to c what i can do

If your IVA has concluded due to your failure to maintain contributions, and if your circumstances have now changed to enable you to make a realistic offer of ongoing payment, you could try a second IVA - but your new IP would need to carefully explain the history of your case to creditors in order to get you a second chance at this procedure.

If you have no assets, could bankruptcy be an option for you? It would mean that you could start afresh without any of this hanging over you.
