It certainly sounds it, and I'm sure they would come up with something in the proposal that they reckon wasn't quite right.

I doubt they even understand what an IVA proposal is Jan. It is shameful that they set up companies using so called official titles, and give such dreadful advice to vulnerable people.

I totally agree.

We both had letters (again!) from Goldsmith Henderson which are along the same lines. They've been consigned to the recycling.

Kallis - yes & today actually we got the same letters again from Goldsmith & Henderson. What a waste of paper! Just worried about when I move they will keep on coming to old address - as I dont want my old landlord or new tenants knowing our business. Plus do you know how an IVA affects a property rating for credit?!

You can have your mail re directed for a while, but of course your old address is on the register.

I don't know how you would stop the letters arriving. You can always write to the ones you have telling them you have moved (not giving them your new address of course!), but that doesn't help with any new companies.

I don't know how you can get round that.

All I know about credit ratings is that once you have an IVA, your credit is stuffed for the next 6 years, anyone else at your address, provided you are not financially linked to them, should be ok.

Thanks for that - I will keep any dodgy letters I get for the next few weeks & send em a letter saying I am not there any more!
I will also write to my creditors too, And obviously inform my IVA company -but I cant rely on them telling my creditors quickly enough - they do occasionally send me something but not for a while now!

Well what can i say, thankfully i found you folks first, because ALL the above was mentioned and i was seriously considering br , changed my mind now, thanks to Melanie and i sent my ip an e-mail and waiting a reply, in regards to struggeling with money, its because my ex boss screwed me for 3 months wages then went bust, so now i earn a great deal less than i did when i entered into the iva, but hey life is a challenge.

Hi David I will email you later today for an address to send all the paper work I got from The British Association of IVA Consumers. Sorry I am not very good at scanning documents into my pc. But I am more than happy to post them to you.

Just a thought too - they claim that if they can prove you were missold your IVA - they can get all the money back that you paid into it. They also claim they are a "non profit" organistation & you would get all the money back - even more frightening & the vulnerable may well be sucked in with such claims.

I wonder what they do with the fees that they charge you for 'assisting' you to go bankrupt? I'd say that would be classed as profit!

I am sure there will be some sort of 'admin' fee for them attempting to get your money back! They're not going to do it for nothing.

Ahhhhh! these people just phoned me again! N did not know what to do....... n put phone down. I was expecting it to be the estate agents that are doing my head in at the mo.
Goodness you would think like saying "NO I DO NOT WANT TO GO BANCRUPT" would be enough to make em go away. Thank god my phone number will be changing in 4 weeks ;-)
