Hi there, not been on for a while. We payed our instalment of our IVA in May last year and our 5 year point was in fact 19 Jun 08. It is now nearly 9 months since the end and still we have no completion certificate despite several phone calls to my IP over the last few months. They keep telling me that all claims have been received and they are near to closing our case but still nothing has arrived through the post. From the outset we were told that the completion process should only take about three months and we are fast losing patience. I know it is only a certificate but we worry that we will get to the point where the IVA should drop of our records and it wont happen. Is there any governing authority that we can complain to if we have no further joy as at the end of the day the IP is meant to be acting for us as well as our creditors. Any advice would be greatfully received.

Which company did you use and are you sure it was your IP you spoke to and not a member of the office staff?

If it was not your IP, you can find his/her direct email address on the Insolvency Service website under the heading "find an IP"
May be worth emailing directly?

If it was your IP then i'm sure Mel or one of the other proffessional experts will be along shortly to offer more advice.

Hi Jack - I can understand your frustrations, you should have received your certificate by now. I think you can complain to: Insolvency Practitioners’ Association

You should find the actual regulatory body of your own IP to directly send any complaint to - there are actually eight regulatory bodies of which the IPA are just one.

Thanks Mel....wow 8 regulatory bodies! Is there not an overall one?

In an ideal world you would hope a complaint could be dealt with locally but if not what would you suggest as a good complaint procedure?

I think that ongoing communication on an open, face to face basis is the best way forward to deal with complaints. None of us are perfect, but when things go wrong in my practice we just try and do our best to put things right.

And unfortunately, there is no overall regulatory body - it would be much easier for IPs if there was!

If only all practices were as "on the ball" as yours. I can personally vouch for your company after having the pleasure of your hospitality [:)]

I'm surprised there's not an overall body...are the 8 existing bodies consitent when it comes to complaints?

As the amount of IVA's increase maybe this is an area which will improve?

There is some consistency, and they do have open dialogue between each other, but it may be some time before we see a consolidated regulatory body.

Many thanks guys for the advice. It has been office staff we have been talking to - normally the customer support team but I did speak to one of the closures team (we are with DFD). It is just frustrating as we need to get on with our lives. Currently saving for a deposit for a mortgage and needing a slightly better bank account as I need a cheque book due to going overseas with my work later this year (any advice on banks/builing societies recommended would be most appreciated). I am going to call dfd again tomorrow so hopefully they will have some better news.

If you do not live very far away from them, why not threaten to camp in their offices until they give you the completion statement and a copy of your final report.

Does anyone from DFD post/read on here???

I like the idea of camping on their doorstep but given the cold weather, there must be another solution?

I don't think anyone does. I think it was being looked into, but not heard anything else about it.

It should be a soon as feasibly possible, and in my book no longer than three months following the making of the last payment.
