I've recently been receiving more phone calls from agencies I owe money to but who agreed my IVA. I've tried to gain an answer from my IVA practioner/company but have had a poor response. Any suggestions?

Hi Helen,

How long have you been in your IVA now? It may just be that the news hasn't filtered down to the call centres yet.

As to the calls, I would ignore them. They cannot do anything to you regardless of what they say.

Have you tried emailing your IP to tell them what is going on?

IVA since beginning of December 08. Yes I've emailed my IVA company, practioner and others but have not received either a response or in the very initial instance, a 'we'll have a look at it' response and nothing since. That was two weeks ago. No update.

I agree with Jan. I know its hard but dont be intimidated by them. Your IVA is legally binding so there is nothing they can do.

Call centre staff usually work on a commission basis and will try anything to make you pay.

I would email your IP direct and have him/her sort it for you by making a few phone calls.

take a look at the insolvency service website under the heading "find an IP" for your IP's direct email address.

They should have stopped calling by now.

Have you checked to see if your name is on the Insolvency Register? If you are, next time they ring up insist that they check the register so that they can see it.

You could also try sending a copy of your chairmans report to the creditors who are hassling you.

As a last resort, you could change your phone number.

Ok.

Who is the nominee and who is the supervisor? I have only ever received a modification document, nothing else. There doesn't ever appear to have been a chairman's report sent to me. I've not received any paperwork since IVA agreed in December.

You should have received your Chairmans report within a few days of the IVA having been approved.

I would give the office a ring tomorrow and ask.

Melanie is posting on here at the moment, and I am sure she will see this post and suggest that you do that.

I put down the IP but to be fair to them I'll give it another couple of days to see if they help, so i've deleted. I'm disappointed though because the start was fairly promising but hasn't been so great since. I suspect that it's a staff problem although I have emailed the IP and not had a response. Could be they've changed their email address?

I entirely agree with your advice Jan. It does not appear to me that Helen was properly briefed about either her IVA proposal, the creditors meeting or the fact that it is very difficult for IPs to get creditors to cease harassing their customers once an IVA has been accepted - but it will die down eventually.

I suggest that Helen finds the name of her actual IP, rather than speaks to a member of staff to explain how distressing she is finding this at the moment, and to ask if they would personally call the creditors to complain.
