Hello all,
We have been sent two letters from our creditors so far demanding money. This is two and a half years after our IVA was supposed to end. We finally managed to get in touch eventually with the IPs office. We could not speak to him we were told to just put in a letter of complaint, it now looks like DM have made a complete mess of our case which was meant to last 18 months and after 4 years our creditors are demanding money. The girl in the office said they had taken legal advice about it she could not help us any further. What can we do about this? She said the IVA failed and did not understand why as we had made all our contributions.

It sounds a mess - and your current IP does need to take some responsibility for this. I suggest that you send him/her a personal letter or e-mail to express your concerns and see where that gets you. Ultimately if they do not deal with this issue you could file a report with their regulatory body, but let's hope it does not come to that.

HI,
Does anyone know what happens if you don't manage to obtain a remortgage within the duration of the IVA,even though you have paid all your monthly contributions.

I think it depends on the individual IVA but I beleive the iva can be extended for 12 months in leiu of the equity release.

Don't let your case be swept under the carpet.
You need some answers and if your IP is not helpful you must take it to the regulatory body.
You are basically back to where you started now and will have more and more creditors contacting you for payments.

Hi Andy,
We are writing to the IP because no one will let us speak to him. We are also writing to the regulatory body. We were told that several other cases under this IP were left to expire and that he had to seek legal advise about this. We have many questions to ask and will keep the forum posted.

Which IP is acting for you at Debtmatters? It is not acceptable fo him/her to refuse to speak to you, and I think this is heading for a regulatory complaint if they continue with this attitude.

This sounds absolutely crazy and disgraceful.
You definetly DO NOT!! need all of this stress
None of this is your fault as you have been paying in the
regular contributions and have been pole axed by a load of old gobble dee gook by your IP which is totally baffling and now you need to find out where your IVA has gone.
I think they should concude your IVA through no fault of your own.
Why should you have to do all the chasing, they don't mind taking your money every month so the least they can do is put you straight.
I would go straight to the Regulator as this is all Totally Absurd.

Hi Melanie,
The name is Gerald Ratcliffe and he is no longer with DM. He is with a company called Unique Business Fiance but they use the same address as DM. When we questioned the name change they said it was "Business restructuring" It was that company that issued the refund cheque to us. Two and a half years late. (what a cheek) maybe trying to cover his tracks we don't know.
