Hi Guys,

I needed to speak to my IP's Team today at Wilson Phillips and was connected to a company called Grant Thornton who it would appear are responsible for my IVA now. When i asked the question it would appear that Wilson Phillips made a business decision to transfer all their IVA business to Grant Thornton. Great to be told as my IVA has failed and i have petitioned for Bankruptcy, the District Judge will not make me bankrupt until he recieves a failure cert which yes, youv'e guessed it Grant Thornton know nothing about. LOL

Grant Thornton are a very good firm but I believe that they bought the live cases. It may be worth speaking to them again as I am sure that there will be many clients in failed IVAs who will need certificates or where the OR will be looking for the original IVA and receipts and payment accounts.

Grant Thornton should be able to advise who to contact looking for such info.

Not good.

I'd keep badgering GT to check your account - you need something from them to say that you have failed. Someone there should be able to tell you something about Wilson Phillips accounts.

Has the judge confirmed you need the failure notice to petition for BR? Hubby didn't have to wait for his - maybe worth checking.

If you do need it, follow Jan's advice and badger GT by phone, email and letter.

I agree with Julie - ask your court first if they definitely need something in writing. If they do need something, it would be worthwhile getting in touch with GT for them to fax or email a document saying that you have failed, rather than you waiting for a certificate.

I just needed a letter from iva co to say that they had no objection to me filing for my own bankruptcy.I was told that nowdays no court will let you go bankrupt without this.

Who told you that? We didn't have to show anything to the judge/clerk. We just put all IVA details in the statement of affairs.

I think it may depend upon which you court you go to. There doesn't seem to be any consistency.

Hi Guys,
Thanks for that spoke to GT again they will issue a BR Cert ASP (within two weeks ) like us all i just want this to be finalised in order that i can move on

Discharged today the 8th feb 2012. View is much brighter now.

I tried to speak to Wilson Philips a couple of days ago only to be put through to Grant Thornton and told about the change. The query I have is that one of my creditors on my IVA is represented by Grant Thornton(I think it's Egg but can't remember),doesn't this raise some kind of conflict of interest if they are to look after my IVA as well?

No, I don't think there is a conflict of interest. GT vote for one or two creditors and I don't think there has been a problem.

Grant Thornton operate very strict Chinese Walls between those who draft IVA proposals and those who vote. I would not be concerned at all.
