From 1st July 2004 access to information to identify bankrupts has been made easier. An on-line database, developed by The Insolvency Service, will provide free, instant access for consumers and businesses to find out whether or not an individual is an un-discharged bankrupt, the subject of a bankruptcy restrictions order (BRO) or party to an individual voluntary arrangement (IVA).
Desmond Flynn, Chief Executive and Inspector General of The Insolvency Service, said
"Members of the public, alongside businesses and 'professional searchers' can make informed decisions about whom they deal with, quickly and easily based on the information disclosed by their search,"
"They now have instant access to information about bankrupts, available free of charge, 24hrs a day 7 days a week. The clear identification of those bankrupts against whom BROs are made will enable people to identify those whose financial failure was tainted by misconduct."
The database, also known as the 'Individual Insolvency Register' (IIR), contains details of current bankruptcies; bankruptcies which have ended in the last three months; current IVAs; fast track voluntary arrangements (FTVA); and current BROs. Entries for bankrupts will only remain on the register for a period of three months after their bankruptcy ends. This is much shorter period than before the change in the law affecting bankruptcies under the Enterprise Act, which came into force in April 2004. Before the introduction of this on-line facility all searches had to be conducted via a written request, telephone call, fax or in person at an official receiver's office.
Desmond Flynn said,
"The register will help to provide greater confidence in the market place helping to contribute to a modern insolvency regime which deals fairly and effectively with financial failure."
