I totally agree!

This register should not be available for everybody and his dog to look at. It should just be for interested parties (rental agencies for example).

I object to my info being on there.

Ok, no one will be able to get credit in my name at the moment, but they only need to keep the details, and why should people I know be able to check up on me?

That'll drop off as well eventually but that may be 6 years after it was taken off.

I'd check to see if they will take those details off. Once everything else has gone, do you really want potential creditors to know that you've been in an IVA?

well i have sent an email to my MP urging him to revisit this removal of personal details that could be misused on the insolvency register, i don't hold out much hope but well you never know!
Om shanti, namesté, good luck to all who are embarking on the IVA journey, it isn't always an easy one but the outcome is the best.

For infomation

02 July 2004
--------------------------------------------------------------------------------

From 1st July 2004 access to information to identify bankrupts has been made easier. An on-line database, developed by The Insolvency Service, will provide free, instant access for consumers and businesses to find out whether or not an individual is an un-discharged bankrupt, the subject of a bankruptcy restrictions order (BRO) or party to an individual voluntary arrangement (IVA).

Desmond Flynn, Chief Executive and Inspector General of The Insolvency Service, said

"Members of the public, alongside businesses and 'professional searchers' can make informed decisions about whom they deal with, quickly and easily based on the information disclosed by their search,"

"They now have instant access to information about bankrupts, available free of charge, 24hrs a day 7 days a week. The clear identification of those bankrupts against whom BROs are made will enable people to identify those whose financial failure was tainted by misconduct."

The database, also known as the 'Individual Insolvency Register' (IIR), contains details of current bankruptcies; bankruptcies which have ended in the last three months; current IVAs; fast track voluntary arrangements (FTVA); and current BROs. Entries for bankrupts will only remain on the register for a period of three months after their bankruptcy ends. This is much shorter period than before the change in the law affecting bankruptcies under the Enterprise Act, which came into force in April 2004. Before the introduction of this on-line facility all searches had to be conducted via a written request, telephone call, fax or in person at an official receiver's office.

Desmond Flynn said,

"The register will help to provide greater confidence in the market place helping to contribute to a modern insolvency regime which deals fairly and effectively with financial failure."

If there was a database of criminals with the same information available can you imagine the outcry and how MPs would say it's wrong to name and shame. I think a slant to anyone who's MP says there is nothing wrong with displaying this information they should then ask the MP to campaign for the same information to be available for criminals convicted in court to see their reaction.

I think the register should just be available, by payment (and a hefty one at that) to people such as financial institutions, letting agents, but not to private individuals.

Quite agree Jan, seemingly this was the case before April 2004 according to the post from johnnybriggs, made very interesting reading, surely this could be argued as discrimination against those of us that have found ourselves in debt for one or other reason, why should ALL our personal details be on the site, they just need to know our name is there and then have a password to access the other info, grrrrrrrrrr and double grrrrr.

I really don't like my information being on public display - ok, no one is going to be able to get credit in my name now, but they only have to note the info and keep it until the time is right.

My iva got accepted last week and i felt ok but today when my name went on the insolvency registar it seems reality has sunk in. At least some people at work wont know its me because they dont know where i live and it doesnt state my employers name or date of birth on the insolvency registar. Now i feel physically sick when last week i was cheerful at being accepted.

It's unlikely that anyone you know will have heard of the register, let alone check it.

If you google your name (depending upon how unusual it is), you will find that you don't even show on there - I don't. I'm a real estate agent, a painter - anything but who I really am.

Just forget about it and don't even check it again until your IVA is finished.

Wickerwish I know how you feel, most of the time I am happy because I am sorting myself out then the 'Insolvency Register' thing kicks in and I am filled with dread. No-one, including my business partners know my situation except for my immediate family! I am scared to look on the register even now and I am not officially insolvent yet! because I am scared of what details it shows of other people and soon I'll be on there too. The only thing is my IP said that unless you are particulary looking for someone most people don't look on the insolvency site.

The way I looked at it was I didn't know about the register before I found this forum, therefore how many other people would know? The chances are if someone is aware of the insolvency register it's because they are on it or have been on it at some point.
