I have had my IVA for 3 years and have just found out that I am pregnant. I have explained this to them and they have responded saying that at the moment I am paying 28p/per £1 to my creditors and with the new revised plan I will only be paying 1p/per pound. But they have worked out a proposal far less than what I can afford to pay, so I have replied saying that I can afford to pay more and they have said that I have to pay £650.00 for this to be put to my creditors.
Is this correct, should I have to pay this £650.00
The company wont reply to my emails and I have left endless messages, the only way they will respond is to mail (which takes forever!)
I am just a little worried about it all and need your advice!

First of all congratulations on your pregnancy and your IVA should be the least of your worries at this time.

The variation costs are normally taken from the IVA pot and this can occasionally mean you would have to pay extra at the end if a minimum dividend is required. It seems unfair that your IP firm can demand £650 up front from you but not return your calls or emails so I think you should contact your IP directly with your concerns. If you have been paying into an IVA for three years there should be enough in the pot to pay for a variation.

Hello,
Many thanks for your advice and your congratulations as well.
As soon as I get this sorted out then I will just enjoy getting fat!!!
I will email my IP like you suggested and get some feedback. Is my IP the person at the debt company who writes me the letters etc? If so I think she is the one who is giving me all the false information,
She told me a year or so ago that if I reduced my payments (at the time by £20 per month) then I would have to restart the whole IVA, which I later found out was incorrect to!

As others have said, the best way forward now is a direct email to your IP. We found it was the only way to get the REAL answers to any questions we had.
That should then put your mind at rest.

Which company are you with Jenny? It seems to me that you are getting rather odd advice from your IP firm, as at the end of the day your maternity leave will be simply temporary and your position is likely to be different when you return to work after the baby has been born.

I have had lots of clients who have had babies whilst in IVAs, and we have merely arranged a payment break period which is relatively simple to do. Can I suggest that you work out your pre- and post-birth figures soonest, and e-mail these directly to your IP for their own personal attention.

Hello,
I am with Gibson Booth.
Can I check with you, who my IP is?
I am in contact with a lady who deals with my IVA at Gibson Booth - is this my IP?
I am proposing to reduce my IVA by £20 a month (due to salary reduction) then have a payment break on maternity and then it goes down for 8 months whilst I am on part time then back to normal amount.
They want £650 to do this and say that there is no guarantee the creditors will except and therefore I will have to go bankrupt.

Gareth Peckett or Edward Wetton - according to the Insolvency Service's records. Do either of these names ring a bell?

I would be absolutely certain, from my experience, that creditors would accept your offer. Not sure they are asking you for £650 when this could be paid as an expense of the IVA. Where do they think you are going to get this money from - you are in an IVA!

Sometimes the topic headings can be misleading. I read this as:
"I've just found out I am pregnant (by: Melanie Giles)"
Essential reading, but wasn't sure if congratulations or commiserations would be in order!!!

Ha ha - Maybe I should change the heading!

No neither names ring a bell, its a lady called Eleanor Oates who deals with my IVA and does the yearly reviews etc - is she an IP ?

My confusion is what is an IP - people keep telling me to speak to my IP. But I dont know if my IP is the lady at Gibson Booth who I have been dealing with from the start of my IVA or if this is someone different? Will by IP work for Gibson Booth?

Please could you advise?

My friend also has an IVA with another company and they seem so much better, she can have payments breaks (and then the term is extended) and they change her payments to suit her change in wages etc and she has never had to pay anything for this.
I can not change companies as i would have to restart my IVA wouldnt i?
I will just be so glad when I get all this sorted out!!

Hi Jenny, and congratulations from me as well.

If you look at your proposal/chairmans report, it should have been signed by your IP.

Use the link provided by Ray to find him/her and email them direct. You should be able to drop your payments, and get a payment break.

It strikes me that you are speaking to a member of the office staff who isn't too sure of what she is doing!

The only way to ditch your company is by letting your IVA fail and then start again, which you don't want to do.

Let's hope you can get this sorted.

The girl Eleanor you are talking to is unlikely to be your IP if she's sending you such letters, but is probably just an advisor within the insolvency practice.

If you are struggling to find out who your IP is, you can use the Insolvency Register to your advantage (apologies in advance if this link is not allowed, but it's an innocent one):

If you search for your name on that form, you will see who your IP is. Then you can email them using rayb's link and ask them to contact you directly.

You should probably discuss the communication problems regarding your current advisor, and let them know that you have been confused over a number of key facts concerning your Arrangement. IPs are generally very concerned about the way their practices conduct business, and I'm sure he will take steps to rectify any mistakes made in the past.
