My DMC told me we have a court hearing next week what does this entail? My IVA proposal has now gone to IP so what is this court hearing? Is this where my proposal is put to creditors or something else? Also had a debt collector knock on my door today!!! He was sent by a credit card provider who we have kept informed all the way - what powers do they have? Is this pure intimidation - we really don't need this harrassment -anyone else had them call?

Hi
The doorstep colletor has no powers at all, just tell them that you are proposing an IVA and to go away.
The court hearing seems strange, I think that they mean the creditors meeting.

It could be a creditor meeting, but you need to find out from your company whether this is correct or not. Even though it does go through the courts, it's not usually referred to as a hearing.

Don't worry about the debt collector - they have no powers at all and you don't even have to speak to them or pay them any money. It's not intimidation as they are entitled to send them round, it's just that it doesn't happen often. I wouldn't think you will see them again if you have explained things to them.

Hi madwithworry,

It's not a County Court Judgement hearing is it?

Martyn

Concur with Andy, doorstep collectors have NO powers. Have turned a few away in the past. I even saw one hobbling away after he tried to wedge his foot in the door when i shut it!!!

I even read that even baliffs are liek vampires, unless invited in they can't cross the threshold!!!!

Similarites me thinks!!! (Wish I had Buffy though!!!)

Our IVA proposal has a county court reference number on it..I assumed it therefore went to court at some point, not sure what it entailed though.
Completion Certificate received September 2012.

It does go to court, but usually the meetings are referred to as creditor meetings - I think the court thing is just a rubber stamp once it has been approved.

Yes I think that must be what is meant as they said it was up to the creditors if they wanted to attend or not - they then said that the packs would be sent out to each of them????
If this is the case then I can't believe how quickly things have moved along!!

That sounds like a creditor meeting to me.

It certainly does sound like a creditors meeting and hope you get a positive outcome, again I agree with other posters re the doorstep collectors. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Ours IVA went to a local court we did not have to attend or do anything but were notified of the event.

I think the IVA's are lodged with the court when they are approved at the creditors meeting

They are lodged with the court as it is a legally binding agreement on all sides.

IVA proposals have to be lodged at Court prior to the creditors meeting, usually at the same time that the proposals are issued to creditors.
