hi all havent been on for a while i got a nagging question guys to ask.
i have had to take a long payment break of upto 7 months due to the fallout of a serious accident i had at work last year, i started my iva fine but i found that i could not keep up the payments as my wage was affected due to having time off and i have been suffering other major symptoms of the accident it was originally thought that i would have made a recovery by now however some of my symptoms have gotten worse its looking like i may have to go bankrupt which is no problem for me but i will still have difficulty making payments even in bankruptcy are there instances in extenuating circumstances where debt is written off due to serious illness or otherwise?
You may be able to get your IP to put forward an offer of full and final settlement based on the payments you have made to date. Worth a try if you have paid a substantial number of payments, and probably would still give a better return than in bankruptcy.
hi melanie well my doctors and other health professionals have said they would do letters to explain my health problems and that they are affecting my life in such a substantial way and that i may be able to get my debts written off legaly due to this maybe if i was to go bankrupt with the backing of my doctors an official reciever may discharge me on these grounds
Bankruptcy is the ultimate route to getting your debts written off legally - so if you have no concerns about being bankrupt this is also worthy of consideration.
hi i just found out from someone that if i can proove that my condition is being made worse through stress and worry because of my debt, and its causing my problems to worsen then my debts can be erased legaly through BR court i have also recently been deemed to have a disibility through my accident ive been told all this can help me greatly and that an official reciever with medical evidence would not ask me to make payments as to the extent of my health problems.
I don't think that anyone would necessarily question your medical condition Andymav - if the IVA causing too much stress and bankruptcy is a better option I would get the application in sooner rather than later if I were you.
Not sure about the advice you have received about the OR's position - that would not be decided until a bankruptcy order had been made, and if you have surplus income in excess of £100, which is not needed for essential medical care, you can still expect to be paying monthly contributions.
