Well my worst fears have been realised. A man saying he was from Barclaycard came to our house asking to speak to me. I was not at home and my son answered the door. The man asked him if there was a contact number for me and my son told him no. Thankfully my son is 6ft 4ins and into bodybuilding but this has really frightened me now and I am living in fear of him coming back. Our creditors meeting is next Wednesday and have repeatedly given our creditors this information but they don't seen to listen. Interestingly the creditors have given myself a lot more harassment than my husband, even though his debts are higher than mine![?]

This is just a doorstep collector, they have no powers etc, just send him away after telling him of your pending IVA.
Why do creditors do this when you are trying to deal with your debts in a sensible and professional manner ?

Thanks for reply. That is exactly how we feel, we are doing everything we can to get this mess sorted and could really do without this harassment, which is exactly what it is![:(!]

This does seem ludicrous and you should inform your IP. The fact that the meeting of creditors has been scheduled means that Barclaycard have ben informed. They should not be sending collectors as there is a de facto moratorium in this period. It used to be illegal for things like this to happen as the IP had to get a court order allowing a meeting of creditors to be heard. This requirement was dropped a few years ago but the principle applies. No creditor should be trying to improve their position at this stage nor should they be inducing you to make a preferential payment to them.

Give the contact number to your IP and I am sure they will give the collector a call.

Nellie I'm sorry to hear that you had a collector, glad your son sent them away too. Must be a stressful time for you but won't be long now and hopefully you'll be within the protection of the IVA x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi Nellie,
I do hope this does not stress you too much and your your proposal goes well, we have had ours accepted on 19th Feb and have had no calls at all except form MERCERS who act for Barclaycard, twice they have called since the IVA was approved and both times claim they have not been informed. The second call was to tell me as they have not been informed they will send round an agent, they said we were not on the insolvency register, I know we are as I have checked, I told her where to look and she then confirmed "oh yes you are", but until we get confirmation we will continue with sending someone, I just told her send who you like as it will only waste there time as the IVA is in place, so will see what happens.

Mercers have been the worst of all our creditors for phonecalls and I assume that the person they sent was from them acting for Barclaycard.I just wish information was passed on to the people concerned instead of wasting so much time & money on unecessary harassment.

Barclaycard/Mercers were our worst creditor and we owed them nothing in comparison the the other creditors.

Hopefully it will be all done and dusted for you soon. x
7 year IVA completed in December 2016 - there is light at the end of that tunnel

Looks like were in for fun then, once we default on our next payment due to Barclaycard on 7th April.
We owe just over 14k, so no doubt the Mercer regiment will be at our door in their truck load.

That's very sad to hear you have been harassed in such a way so close to the meeting of creditors. Don't worry it will soon be over, once your IVA has been agreed you are protected from this type of thing.

Surely if you haven't defaulted yet it's a long way from getting a doorstep collection.
Don't you have to fall into arrears with your payments for a few months before it gets to that stage?
And in any case, you'd need a default notice first I would imagine?
All these horror stories about Mercers scare me to death because my dad doesn't know about my debt and if they came knocking on my door - it would be terrible for him - and he doesn't deserve that. It's not his debt!!
If it came to that situation, I would do all I can to keep up the absolute minimum payment to Barclaycard while my IVA was being set up. I cannot risk my dad finding out by way of an aggressive doorstep collector. He has a weak heart and is not generally in good health and so this could really hurt him.
Now debt free after F&F in July 2012.

We were at least 4 months behind before our IVA was accepted and never had a 'home' visit if that makes you feel any better. Barclaycard/Mercers just rang the ears off our phones and sent threatening letters.

What happened then? Did they stop contacting you pretty quickly?

Hi Sunkendrailer,

I can understand your stance and worry regarding mercers calling at your door, and your fathers health. I would imagine that you would have to have defaulted a few months before the heavies came knocking.

No doubt other members will clarify Mercers modus operand.
