Mercers were my worst nightmare. Loads of calls via landline and mobile. I ignored them all.

Halifax were a bit of a pain as well!

In my opinion this level of contact would be deemed acceptable by the regulatory authorities when a debtor is not communicating.

Even when there is nothing new to say communicate with creditors and you go to the back of the Q

Why should you change your telephone number becuase of their harrassment?

Call them and state that in your view their continued harassment by telephone puts them in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. Also let them know that on the phone, and in writing, that you are going for an IVA etc .


Follow it up with this letter(add iva bit if needed)

I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Personally, I would rather change the number. By the time they get a letter and do anything about it, you will have been inundated by calls.

Even though we don't like it, and it should be stopped, they are allowed to telephone to try and get us to pay.

You have to remember they are employed to get money from people who arent paying. Some people choose not to pay even though they can and others like the posters on here cannot afford to pay. The people on the phone cannot tell whether you are a "cant pay wont pay" or someone who is just trying to avoid making payments.

Hi

Creation finance have been the worse for me. Constantly calling and leaving messages. They also tried on the automative messages to me which blocked my phone line for a while.

I called BT and asked them to block all 0845, 0870 and 0800 number as I was fed up with silent calls. It took 48 hours for them to stop, but has certainly helped.
F&F accepted 12/8/13 - Awaiting Completion Certificate :-)

It's actually got worse. They only called 3 times yesterday but they called my parents landline. I took that number away from Egg 6 months ago! They pretend that they'll never call it and they've got rid of it from their records but no! I don't even live there anymore.

Thi is disrupting my sleep now, I woke up in a panic at 4.30 this morning. So tired now!

I dont think companies ever really remove numbers from their databases.

I'm waiting to hear back from people so I don't have an update for my creditors at the moment.

I can't think about anything else, I'm surprised I haven't been fired from my job the amount of time I spend checking my emails, running out to take phone calls and staring at this forum!

My wife and I are applying for a linked (joint IVA). My wife has a credit card debt with Egg and out of all our debts it is the smallest. Egg calls my wife at least 3 times a day! First they will ring her mobile then they will call our home (so at least 6 times a day).
They just repeat the same old spiel and once even said they would not talk to my wife unless she gave them her debit card number first. My wife, who has been really struggling with these calls finally lost her temper, told them that they had called her not the other way round and hung up.
She now no longer answers the calls and is much calmer about it now, as how many times can you tell someone the same thing. We have told them to talk only to our IP (which they haven’t) and leave it at that.
We feel it is out and out harassment by Egg but luckily for us they talk so much rubbish that it has given my wife strength to ignore them.
Luckily for us we found this forum first and with the help of JonesGiles we have the confidence now fend off this rubbish (to be fair though still not easy by any means).

I just spoke to them (was feeling brave!) and it was okay but they asked if I would make a token payment. I said I'd been advised not to. (This is sort of true - no one's told me not to since my iva was turned down, I just assumed) Anyway, Egg said it was the only way to stop the phone calls. Should I just do it? If I end up declaring BR will it make a difference anyway? Can anyone advise me please?

It won't stop the calls. You might get a reprieve for a week, but they will start again.

If you change your number they can't get hold of you.

The thing is, I think that would mean they'll start calling my parents again. The man said they tried that number because I didn't answer my mobile.

Your parents could also change their number?

I know they shouldn't have to but at least it would save you, and them, all the hassle.

I agree with Jan, making a token payment would only hold them off for a week n then it would all start again.
Either dont answer or if you do when caught of guard - dont confirm/answer any of the security questions n they can no longer continue with the call (confidentiality practice etc).

Changing numbers or just ignoring them is the best idea hun.
Final IVA payment made in April 2013, never ever thought we could do it or get through it but we did! X
