IVA With cleardebt.... i am confused...

Morning,
my husband and i are in the process of an IVA. We are using cleardebt, but the man i speak to has managed to get me very confused. We recieved the draft documents, ok'd them, then received the final documents, signed and returned them on Monday, they should be there by now.I had a message to call them on Tuesday which i only picked up this morning, and called back. No on my account online it says 'paperwork ready for creditors meeting' but the guy i speak to said that all creditors had already been contacted and it is all agreed they are just waiting for my signed paperwork. How can it be agreed without this, and at which point were the creditors contacted. He is a lovely bloke but i can't help feeling he has gotten my case mixed up with another. or maybe it is i not understanding the process clearly enough. i don't want to get my hopes up that it has all gone through if he has gotten it wrong. Has anyone else used cleardebt? how did the process work for you?

Hi Loopy and welcome! :)

By using the word "agreed" he's being a little confusing - as you know, the IVA will only be "agreed" at the meeting of creditors. What he perhaps means is that the IP has agreed to send your proposal, and the company has received statements and authority to deal with all of your creditors.

Your IP may well have been in contact with your creditors to fax them a copy of your signed authority, and request statements in order to prepare the Statement of Affairs. This is not the same as agreeing to your proposal.

thanks for the reply, i didn't think i had understood it correctly. As I have only just sent the paperwork back. I will wait for them to contact me with the date for the creditors meeting.

I'd give them a call just to clarify. It doesn't sound like communication has been very good and you really should have been told exactly what you were signing!

I have just called them back and spoken to someone else, and my creditors meeting is set for 1st November. Just a waiting game now....

Have you actually spoken to your IP yet with regard to running through the proposal documents? If not, who has assumed responsibility for this important part of the process?

hi,
me and my husband are with clear debt we have just been told that our creditors meeting is also on the first of november. our process leading to this point was the inital talk on the phone. we then sent information on our debt, very painful. about a week letter we recieved a draft proposal, on agreeing the draft we were told this had been agreed and accepted to take through to final proposal. we signed the proposal and a few days later recieved letter on creditors meeting. throughout the whole process we have found them very professional. i have rang them serverl times with probaly silly questions, they have always been answered and dealt with straight away. ring them for your piece of mind.
i hope we both get a postive result on the firstx

hi
can any one help we have gone over the overdraft on the bank account which is going in the iva (if accepted). this ahs happened due to bank charges. do we need too get back to the agreed over draft limit before the creditors meeting on the 1st nov?

Don't worry. You will get charges until the IVA is agreed and these will be included in the IVA.

You should not need to. All banks will continue to take money out until the IVA is agreed. HSBC did that with me every month.

Speak to Cleardebt and tell them what is happening.

thank-you for responding so quickly its nice to talk to people who have been through it and have some understanding of how we are feeling. we are so cross at our selves for getting to this point. i really didn't want to go down the iva route. however since reading this forum i feel that we will cope and there does seem to be light at the end of an iva, i hope we get to that point. thanks to all it's nice to read the forum and know you are not alonex
