hi I'm in an iva and have been for two years some of my creditors are sending me letters saying i need to make full payment. I know that by law the have to send me a yearly statement but not these letters. Is it against their teams and conditions to keep sending me these letters??? what happens if they keep doing so.
I have contacted my IP and have also told the company first hand and still contacting me
You should not still be getting letters demanding money now. Your IP needs to have a word with them and you can write and tell them to desist or you will report them.
Of course the one good thing is that they are worthless and can't do anything to you.

I got a letter myself the other day saying my Freemans account had been passed to EOS debt collection, I rang them straightaway and they apologised for their error and told me to disregard their letter. I noted the time/date and person's name I spoke to and will send the letter to my IP with my 3 monthly accounts in due course and hope I don't hear anything else. The lady I spoke to did say it was an error but nonetheless would have worried some people.
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.
I am having problems with creditors over a year after finishing my IVA with a full and final settlement in June 2009 - my IVA wont come off my credit record until January 2013 but the problem is that two creditors have put on my record that I am continually defaulting and not paying back the loans that were of course included in my IVA. One (Santander) writes to me every 6 months and tells me I am in default and I should be paying them in full and when I phone they say dont worry nothing will happen - it is a letter we have to send. However I am trying to get my credit record up to date and I do worry about it and have now written to all the credit agencies and the creditors to try to sort this out. What does Mark mean when he says that there is a law that creditors have to send a yearly statement - I did not get that when in the IVA save from Santander.
i suggest that if this is still happening then the iva company are not dpoing their job properly. we got told that for the first 2 years no money what so ever that we pay into the iva actually goes to the creditors it all goes in the pockets of the iva company.
our advice would be to fail it like we did and go bankrupt at least your not tied in for 5 or 6 years and the debt gets wiped straight away.
I'm sorry, but I don't understand why anyone would want to go BR 2 years into an IVA just because they are receiving letters from their creditors!
Anyone who did this would be subject to an income payment agreement for a further 3 years, which would most likely take them to the end of their IVA anyway, and their credit rating would be shot for a further 6 years from the date of BR.
If you are having problems, the first port of call should be your IP, and I'm sure they'll be able to sort things out.

Hi Mark stick with your IVA you just need to get your iva company to get it sorted you may need to be a bit more assertive and make sure you put everything in writing and confirm things in writing and speak to your IVA supervisor this should get it sorted do it now as this is unecessary worry and shouldn't be happening best wishes Oscar

I agree with the above posters. The letters may be a pain but they can't hurt you.
Hershman - your creditors are supposed to send you out a statement once a year. Nothing to worry about.
I would write to the head offices of those companies still defaulting you enclosing a copy of your completion certificate and insist they remove everything post IVA acceptance.

As has already rightly been said, the best course of action is to speak to your IP company and ask them to write a strongly worded letter to the creditors involved.
One other thing you could do is send a strongly worded letter yourself together with a copy of the Chairman's Report confirming your IVA was accepted. I suggest you mention that as you are in an IVA, you feel the constant letters are harassment and if they do not stop you will report them to the banking ombudsman. This normally has the desired affect.
In terms of msi-leadkings's post, failing the IVA is certainly not the right course of action at this stage. To suggest that someone should do this with no additional information about their financial situation and property is foolhardy.
I agree, talk to your IP and let them contact the the creditors. It's probably down to someone not updating "system" properly. You're in a legal binding agreement, so try not to worry.
halifax are my only creditor that has not updated my credit file showing a outstanding balance to this present date,although my iva was concluded over a year ago with a full and final.my other creditors have put a partially settled abreviation on my files from when my iva was concluded.this will stay on my file for another 5 years before it drops off,so it looks like my files will be shot for 10 years since the start of my iva ,because partially settled wont stand much water i would have thought.
tahnks for the post's you are all thinking along the same lines as me. I just annoys me that they don't stick to their side of the bargin, but i bet if i don't they will be all over me like a rash.
