Can I ask for IVA in court tomorrow ?

I owe a creditor £28,000 and he has a county court judgment against me for it. He has issued a bankruptcy petition and I am in court tomorrow. What can I do? Can I ask for an individual voluntary arrangement at the hearing?

Also, the opposing side have not provided a draft bankruptcy order - do they need to do this? Can they give this to me at the hearing? Or will the court just write an order making me bankrupt?

Hi Alex and welcome to the forum, I'm unsure of the procedure in court but will bump this back up and hopefully someone will be along very soon who does know. x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

You should ask for an adjournment to allow an insolvency practitioner time to look at your case. Most judges will grant the adjournment and if an IVA is the suitable option a proposal can be drafted and lodged in advance of the adjourned hearing. Your IP can apply for a court order suspending all legal action but it would be impossible to do it at this late stage.

Contact an IP firm for some free advice as it is possible to do something even at this late stage. Your IP could fax the court should the judge want confirmation that you have instructed one.

Try www.iva.com for a list of companies and some reviews of these, might be best to act sooner rather than later but still ensure you take the advice of at least 2 if not 3 companies to ensure you get free impartial advice. x

That's great news. I hope an iva works out for you. Keep posting with all yur questions...you'll have plenty over the next few weeks! The forum's also great for getting a second opinion (or third or furth or fifth...) on anything that doesn't sound or feel right. Best of luck x
