I know I am annoyed about it but really whats the point of taking it further with only 10 months to go. To top it off they assumed I would be making a full and final payment so neglected to tell me I wouldn't meet my minimum 50p in the pounds term if i didn't do a full and final. Uff now I have to find £6k or face an extension.
They told me they never mentioned it before because once or twice my parents offered to make a full and final if they accepted £6k but they wouldn't but they told me they just assumed that the money would be given eventually - hmm oh well
They certainly shouldn't be making assumptions like that, if your offer is refused then they cannot think that the money will be yours to pay across at the end.
Does it actually say anything in your proposal about this?

what twaddle,i assumed that i would be able to pay back my credit cards fine but that did not happen.
this is a legal document that you and your creditors agreed to at tho onset.
you dont assume a figure of £6000 will appear magicaly.
this is what gets my goat when we are told these are the rules and then somebody in there wisdom decides to alter something and says "cant change it" when they get it wrong[:(!]

I have requested on numerous occasions that they remove the notice of breach from my file that I am still finding it unacceptable for it to be on there but no-one is responding back not even whoever looks after my file.
Additionally I spoke to someone today who said I didn't need to make a lump sum at the end of my IVA to meet my dividend but then came back 10 minutes later and said e would go through everything with a practitioner tomorrow - there is always someone who keeps giving me wrong information and I'm really sick of it. I checked my log of emails today and in one of them a representative has said that I had told them I would always do a full and final settlement at the end and furthermore that my parents will give me the money - there is nothing in my contract to say that is what I will do. I know I have twice asked them that my parents are willing to give £5k to settle but was told it was too low so on the last conversation I said ok my parents will now not provide any money and spend it on a new bathroom for themselves which is fine its their money.
I just don't see why all this time they have assumed that I will pay a lump sum when it is not what was ever agreed.
I really want to complain - why pay them all this money to look after my IVA when they haven't been. They don't communicate with me - it was me who first asked them whether I am on track to finish in Dec and only because I asked did they then tell me no - surely they should be checking that I am on track on my annual review of which I still even had anyone call me for my Dec one.
If your contract doesn't require a lump sum F&F then you are under no obligation to offer one and it shouldn't affect how your iva is managed. It doesn't matter what an informal note on their files says. I'd be throwing my toys around by now so you're being very nice! Insist on speaking to your IP now until this is resolved to your satisfaction. I feel for you xx
I have called them alot over the past month or so to discuss this further but noone cares to want to. I have been promised call backs but they never happen I as promised a call back by a supervisor at 2pm today nothing happened and Im told ot call if they don't call me. Its expensive to phone in especially since I only have a mobile!
So you are right I am being too nice. Is there a complaints process anyone knows about?
