Can school fees be included in my IVA?

My mum paid my sons school fees and this was not included in our IVA which was taken out last year. My mum has said she cannot pay this year and I need to know can it be added on to the IVA

Hi AdC12 and welcome,

It would depend on your creditors I'm afraid - some will allow school fees as expenditure and others can be difficult. You should talk to your IP and see what they say, and expect to propose a variation to your IVA before you get a definite answer.

How much are the school fees, and how much is your monthly payment?

this was his last year and the total for the year comes to £2200 there will be no more school fees as he has left.

So is this a bill for the last 12 months? You may be allowed a payment break to pay the bill but check with your ip.

You cannot include a post-IVA debt into the IVA, and it is doubtful whether school fees would be deemed to be an essential item of expenditure unless your children are at a critical stage of their education.

Hi adc - did you mean £2200 or 22k? The bursar may have some discretion here or be able to offer financial assistance. I do have one friend who moved schools every year or 18 months because her mum never paid the fees and they were always written off.

Not in this current financial climate! I think most schools would pursue a debt.

I agree with you RHB. I can't see any private schools writing off a debt these days.
