Not if their advice and plan of action was wrong and the information provided was lacking all the alternatives. also as in my case a different option was 'pushed' on us instead of the one we wanted.

Hi,

I was on DMP with CCCS but just for one month and then decided for IVA route. I've sent them a payment in July and one of the creditors didn't get the cheque as they send it to a wrong company...
After few complain emails they decided to send that part of payment back to me but no idea when...

Just received this from PP, not sure where they get this info from but I will check with Insolvency Service on Monday as i can't find any reference to this on any IVA sites.

The IVA was not an option because one of the IVA criteria is that the Debt Management Plan needs to be more than 7 years long. Back then, based on your circumstances, your Debt Management Plan would be finished in less than 7 years..

This is really starting to smell very fishy.

Hi P. That statement does seem flawed. No-one can predict how long a DMP will take to pay off ( only, possibly, a minimum period, which will only be achieved if all creditors agree to freeze interest and charges over the life of the debt -- which is unlikely). The DMP they state would have been finished in less than 7 years could have taken 10 -- even 15 if a creditor played up.
My opinions are merely that .. opinions based on experience. Always seek professional advice.

Don't want to give them any heads additional up info so have to keep things as they are till it all gets sorted out. Then I will post my comments. There are a number of PayPlan's 'advisers' on this site it would be inappropriate to give them any information.

I have obtained a Judgement against PayPlan but before any enforcement action can be taken I was informed by MCOL that the case has been 'passed to a District Judge'. They can't comment till a reply is received. What does this mean, can the Judge reverse the judgement or is this a formality. No defence was filed by PayPlan before the 21 days expiry date although they filed an Acknowledgement of service, so that is why they had extra time.
