Debt free direct, the company wouldnt let me pay because it had gone into the iva, so I either had to pay the full amount or nothing ??? that was a bank, they wouldnt accept part payment

Wekk surely then they should have taken the secured loan into the IVA, but they said they couldnt because I wasnt in the IVA, lol, sorry I have now made this all sound very complicated

That's not good - usually as long as you can make the contractual payment there shouldn't be a problem.

Hopefully you can get something sorted. Declan can hopefully pick up on this tomorrow.

A secured loan cannot be included in an IVA, it has to be paid outside of the IVA.

Secured loans cannot go into IVA's only unsecured debt.

Thanks Kallis and all. Much appreciated, if anyone else can add anything please do not hesitate,cos this is all a bit of a mine field at the minute. Think I may trip to a solicitors about this one because I think this reclaiming ppi stuff is all a bit dodgy, and I certainly am not giving away £13k of my cash to pay this company a nice fat 30% charge, or debt free direct the commission they will most certainly get on it. I feel a major problem coming on, but what would life be without its little challenges lol, thanks all

If you do feel the ppi was mis sold you can make a complaint on your own behalf you do not need to use a claims management company who will charge a fee or take a cut.

Thanks Honey, have been thinking laterally about this one and its actually making me giggle a little now. Have posted on the last entry of yours earlier today. Have a read on my take of it and hopefully you too will have a little giggle.

On grounds of transparency, if the IP is to receive a cut of the reclaim - in excess of any usual fee he/she is entitled to draw based upon asset realisations, this would need to be disclosed to creditors and yourselves in the next annual report. Our regulators are very hot on unseen remuneration at present, and most firms will be aware of the need for honest and transparent accountability to all parties.
