You made a very valid point earlier on in this thread about the fact that i represent a large a company on this forum and that i should expect tough questions - this i fully agree with and I always try and answer these questions as best I can whilst trying to be as transparent as possible.
In relation to my last post where i mentioned that other factors are involved in a PPI claim, by this i meant that whilst someone took out PPI in good faith, it may not have been sold correctly and not all the conditions of what constitutes a valid PPI policy explained. In these instances, i would say that it should be looked at and if it transpires that a claim is not suitable then fine.
Does that mean though that even if a client says they were not mis-sold ppi you will still procede with a claim? I can almost understand why you would do this given that someone could say no they werent mis-sold anything then reclaim post iva. But perhaps the wording on your letters could be better.
Reclaiming ppi for the benefit of creditors is without doubt a good idea,however this should not result in insolvency firms gaining financially as well as 3rd party firms getting a cut,and some clarity on fees involved I assume is contained within the letters sent out?? If not shouldnt it be?
Companies like DFD and a few others without doubt gain clients because of the fact they are represented on this forum,its often the 1st place people come for advice,therefore I dont feel that its wrong to want to get to the bottom of issues when they arise. PPI will continue to be a major issue and its worth getting all the correct information circulating sooner rather than later.

Paul - it does sound from Declan's answers that all PPI policies must be investigated and the client is not allowed out of this process. It is the same as my firm. Personally, when these firms know that claims are not being contested, it reeks of opportunism and it stinks that clients are knowingly made to submit false claims!
It does smell a funny colour as a friend used to say!!
Personally if you think you have a claim I would look into making the claim yourself,so that any money gained goes into the pot directly. There are hundreds of online guides to making the claims.
I understand what Declan is saying that some people may not realise that ppi has been taken on loans etc as some of the selling tactics are questionable to say the least.
This will rumble on and on.

Iv had this bother with the ppi, my iva got extended as I owed 217 which I paid the same day I found out, I had been asked to submit a claim for ppi by Harrington brooks a few months back, I received a cheque made out to me and Harrington brooks rang I raised the question that I'd payed my dues and the surely this was mine, I then was told I would be rang back in days, I was not, this 6 month extension ends on 30/12/11 and I have given my terms and conditions a very good read and from what it seems is if I don't get another extension notice which can only be for a further 3 months no less than 7 days before 30/12/11 then my iva is ended totally. Yes I need to wait for certificate but my debts are paid and this money would be mine. Am I right in thinking this the paragraphs in my terms and conditions that seem to relate to this Are from 5 to 8?
Hi - there's no hiding from the fact the claim will need to be paid to creditors before your iva can complete. Not receiving a phone call doesn't change the fact you received a windfall.
Agree. You will always owe the full amount to your creditors until you get that completion letter regardless of the fact that you have made your final payment so.any windfall needs to.be paid across.

Is that an unwritten rule then? I'm not bothered of this cash needs to be handed over to complete. I have tried numerous times to speak to my ip and someone at HB who has any kind of clue but I'm gettin nowt from them, the terms and conditions say after the completion date then it over as long as I have paid my bit and I have I have never missed one payment someo months I have paid more even. Seems a bit of a grey area to me, the loan company sent a letter with cheque saying a sum of money will be paid into the loan account and what's left sent to me.
Iam also not trying to hide from anything I have the money ready to send back when HB finally get back in touch with me, I was only extended for 6 months that date is up very soon they are dragging their heels with this and it is very unprofessional.
