Still receiving default notices after IVA completion

Hi there, just wondering, now our IVA is completed (we closed it early, accepted £7000 as final payment) All companies agreed and we now have our completion certificate BUT we are still receiving default notices, which show the final payments made, should we still get these, I didn't think we would as the companies agreed to close our IVA early and accept their final payment in full and final settlement of their claim? Any ideas????

Have you checked your credit files with all three agencies to see what's on there?

Hi,

As lem says, make sure that you check your credit record. The IVA will still show on there for six years from the date of acceptance.

Just write to any creditors doing this enclosing a copy of your letter and tell them to remove any defaults on there.

Well, I guess this boils down to whether you want to take control of this whoopa or allow your creditors to be in control, if it were me, I would be getting hold of my credit files now, making sure they were all updated to say the IVA was completed and then ensuring that each creditor had updated their files accordingly and any defaults registered after the date of your IVA acceptance are removed. It is your responsibility to do this and unfortunately your creditors won't do this for you.

I do understand what you are saying, but as we know in the period before your IVA is approved our creditors say one thing and do another and the right hand doesn't seem to know what the left is doing half the time, so I certainly wouldn't trust them to sort the mess of my credit file out after completion and would want to take charge of that myself.

very true do it yourself is good advice i have mine to come next month.....had a look at my files a few months ago so have a good idea what i am in for
time is always the answer, stay focus and you will reach the end all in good time

I am surprised I have to do this to be fair, I presumed that the companies concerned would end the process, as they do once payment has ended on a non IVA agreement. this, in theory is the same thing, they have agreed to end a credit agreement! however I shall write my letters etc and hope I am not banging my head against a wall too long!!! PS Eversheds who deal for Max Recovery sorted my stuff out ASAP!

I don't think though that creditors will do any work that they don't have to do, remember, they're a business not a charity and I would imagine that once they know an IVA is completed successfully, they're just going to write off the debt and leave it for the debtor to clear up the mess that's left behind.

Yeah, perhaps I just figured they would want to finalise files etc, but like you say why would they bother!!!!

It's the debtor and the CRA's who have to tidy up the credit files. Creditors really don't care about your rating once the IVA has finished.
