Hi, I was after some advice if possible. I finished my IVA in October 2011 and I had written confirmation detailing what was agreed at the creditors meeting. However, I have subsequently not recieved my certificate of completion and when I called the IVA company to query this, they said there was a delay due to tax issues with HMRC and they would not be able to give me any idea of when I should expect to get this. Has anyone else experienced similar issues and is there anything that I can do to get my certificate of completion. I would like to get my name taken off the insolvency register asap but I understand that I can't do anything without the certificate? Any advice would be appreciated.
You need to formally write to the Insolvency Practitioner dealing with your case and ask why you still await the completion of your IVA. The HMRC VAT issue has caused delays but quite frankly 8 months is totally unacceptable.
Thanks for the advice. I will try that and see if it makes a difference. I have called the a million times over the past few months to no avail. I just wasn't sure if there really was an HMRC issue or whether I was being fobbed off!
They have already posted on the forum this week to say that they are following regulatory advice and not closing cases until their VAT refund is received. I have only just received my refund from HMRC and we put the claim in in September 2011 - but I took the commercial decision to carry on regardless. There is not right answer to this, and unfortunately the IP firm concerned cannot be criticised for following their regulators lead - even though some of us have managed to find a workable way forward for the majority of our cases.
