I am one of the ppl that have unfortunately got caught up in this HMRC issue with VAT.
I made my last payment towards my IVA in May 2011 so it ran for 5 years and 2 months. In November 2011, I started a new job and my employers wanted confirmation that my IVA was complete. I was issued a copy of a completion certificate to submit to my employers.

My IVA was initially applied in March 2006 so from my understanding this should have been removed from my credit file after 6 years so, March 2012.

I have recently looked at my credit file as I am preparing to apply for car finance, only to find the IVA still listed as outstanding thus dragging my credit score down quite considerably. On contacting Experian, they informed me that DFD had failed to notify them of the completion of my IVA and I would also need to send in a copy of my completion certificate which I did.

It has taken me four days to speak to someone in DFD about this only to be told that my case is still open due to this HMRC issue which I knew nothing about. Considering my IVA completed over a year ago and I was issued a certificate, how can it still be open and how can the CRAs be allowed to hold incorrect information about me due to DFD's lack of communication?

I'm sure you can understand that 5 years in an IVA was bad enough! A further 1 year before it drops off your credit file is even worse but this, 6 and a half years of persecution now and there is still no end!!

DFD reckon it will take another couple of months but this is unacceptable. From what I understand, they are dealing with cases that completed this year and cases from last year have already been finalised.

I'm not sure what to do now as I basically need the information in my credit file corrected in order for my application for credit to be approved.

Any advise??

Don't mean to bump this but I have been waiting for a response from an expert for 2 days. I can see the experts are on but no replies!!

Hi Jayla
I would send a copy of your completion certificate to Experian and the other credit reference agencies. Experian are notorious at being very slow. I would also send a copy to the Data Controller of any companies that have original default dates after the date of your original creditors meeting. By doing this your defaults will be removed now

Also meant to say you need to allow them 28 days to correct this before taking it to the Ombudsman

If you have received a final report with a copy of your completion certificate I cannot see how your case can still be open! This does not sound right, and have you checked on the Insolvency Register to see if you are still listed as being the subject of an IVA?

Thanks for the replies.

I have sent a copy of my comp,ration certificate to Experian but I have not received the final report.

I am still listed on the Insolvency Register and when I questioned this, they informed me that DFD had not notified them of the completion of my IVA.

The good news is that Experian contacted me this morning and confirmed the removal of the IVA from my credit report as I had sent them my comp,etion certificate and it is well over the 6 year period. They are not bothering to wait for confirmation from DFD.

I must say that DFD have been completely slack in their handling of this and despite my constant phone calls and emails I am yet to hear a word from them!!

Well done DFD. Way to go to persecute your clients even longer than usual! It's a total disgrace!!

I am sorry - but I simply don't see how a Certificate of Completion can have been issued without your IVA being finalised. I guess that is one to bounce back to your IP who does have detailed knowledge of your case.
