This again shows that people in debt should get thier advice from the independent professional sector rather than bank funded so-called charities.
It would be a disciplinary offence in our firm to tell a client they are not allowed to speak to their IP and your treatment is a disgrace. If you cannot speak to the IP complain to the regulators.
Assuming that your IVA is in accordance with the IVA protocol, you can extend the term automatically by up to 9 months to pay over any outstanding uplift sums. The serving of a Notice of Breach is therefore completely inappropriate.
Your IP won the Insolvency Practitioner of the Year award last year, so the fact that she will not discuss this with you - given that she is persoanlly responsible for your case is rather suprising. If, on the other hand, her staff are refusing to alert her to these matters, I would have thought she would be pretty concerned about that - hopefully someone will now draw this to her personal attention.
Ive read alot of posts on different sites about how much the cccs are funded by the banks, but advertise as a charity.
Do you think they should diclose how much they are connected to the banks?
We have gone with the cccs and so far its going fair, but i guess it must be better to be able to have a smaller dedicated team to deal with our cases?
I don't think that CCCS have ever hidden the way they are remunerated by the banks. No great secret about that - and important to remember that the CCCSVA arm are as commercial as the rest of us.
I do get the impression it's her staff not her personally. Which there is an element of understanding, given how many IVA's (and other stuff) she will be managing. We will see where I get tomorrow when I contact them!!

Steven.
I hope everything goes well today and you get it resolved.Do not let them browbeat you or talk down to you.
Baldy.
I have my doubts about the CCCS as do many people but what I hate is the fact that they get so much publicity from the mainstream media. I can undertand the banks advising people to go to the CCCS because they fund them but there is no justification for the media advising people to go there. Most independent professional firms offer free advice but are referred to as 'sharks' etc. This sickens me.
The CCCS receive thousands of calls per month and have one IP!!!!! How can one IP provide the level of service needed? We have four IPs and only do about 80 IVAs per month but anyone in debt should go to the CCCS 'charity' rather than a professional firm.
We have found the CCCSVA to be fine so far,our salary increases have not been accounted for until review and whilst we are awaiting the outcome from our 2nd one the first was tweeked about to keep our payments the same.
With this review we were asked to let them know if we wanted it doing quicker in case we were struggling with our payment which was caring I thought.
Perhaps it is down to who looks after your case? or it may be because our payment is high?
Regards.

Hi Steven glad to read that you should by now have picked up a direct communication from your IP - hopefuly, if you still wish to speak with her this is allowed to happen also.
Keep us posted how you get on.

I emailed the IP, and she got straight back to me today on the phone. She was very understanding and apologetic, and has removed the breach and demand for the extra money as overtime. It was nice to finally speak to her!
Another hurdle cleared!!!!
Thanks again, Steve.
