Thanks everyone, well hubby spoke to the bank yesterday afternoon and they had no hesitation in refunding the money to us, they told us it would be in our account within 24hrs and when I checked my online banking this morning, it was there.....along with a duplicate refund from Kwik fit!!, only took them 13 days, I am presuming they will just debit it from us when they get around to it, better make sure I don't spend it now!

Better late than never I guess. Hopefully they'll not bother taking the duplicate back!
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Lem,

Now that you are armed with the FSA information I hope you have some luck at the bank - unfortunately as you say if the bank just simply 'refuse' there is not much you can do about it at the time. Usually this is because the staff at the bank are either unaware of the regulatory requirements that they must give you an 'immediate' refund (poor education of staff) or they are they are instructed to try and 'fob customers off' where possible.

As I understand it Kwik Fit took the money and used your card details without authority and should have reversed the transaction immediately (the money should have credited back to your account at midnight at the latest) but having not done so, the bank, once informed, should have stepped in and immediately done what is called a 'chargeback' and retrieved your money back for you.

In any case as well as Trading Standards I would make a complaint to both Kwik Fit and the Bank since 'neither' have acted correctly in the circumstances and you are entitled to be compensated accordingly.
