tax credits are stating that i said i was single when i was not please help me im besides myself time in question is when I was in an iva can i do anythink 10K is alot of money

Do you have any evidence i.e. copies of documents sent to them that evidences you did not state you were single?

Are they reclaiming money from you? x
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi Parjay - when you received your tax credit award in the post at the time wouldnt it have said in there that you were single or in a relationship? I know it does on mine as it asks you to check all your current details are correct and contact them straight away if anything is incorrect.
Inter-locking IVA approved 25th Feb 2013 - F&F offer Accepted 06th July 2017 - Completion Certificate received 20th July 2017

Hi they are trying to claim it back from me and no it never stated i was single but they are stating we where as i did tell them my partner went to his moms for a week all confusing as we have never split up ever just alot of stress from IVA

I had a big dispute with tax credits back in 2003/2004, but I had proof it was their error & it took them a year to investigate it, very stressful as it affected everything during that time financially.

I'm I reading it right that you were claiming as a couple & then put you down as single & have been over paying you? How long for? Tax credits are usually pretty on the ball with sending new award notices when changes are reported, so you should of had a new reward notice to check with a new payment schedule.
Do you have these filled away somewhere? It might sound daft, but do you know the date you phoned them?
Final IVA payment made in April 2013, never ever thought we could do it or get through it but we did! X

Hi they said cus he went to his moms for a week they are saying i was single when i was not i appealed and they said there decision is final i did speak to someone last night and there getting someone to contact me but it does not sound promising but why should i pay back what i dont owe so from april 2011 they claim i owe them money but what if i was on my own they would have had to pay me more i have saw on the internet that you can claim notification enteliment ??? because if i have to pay all money back for that year i would have recieved nothing at all dont understand at all very confusing surely they cant pay me nothing ?? any help would be appricated as im so depressed dont even want to go work worried sick cant eat or sleep[V]

You may want to consider making a claim for "Notional Entitlement"

Where HMRC decides that a person’s award has been incorrect, for example where they discover that a lone parent has been living with a partner, they will reassess the tax credits award on the correct basis. They may also treat any amounts already paid on the previous claim as an overpayment.

In many cases, when HMRC calculate the amount overpaid, they will take into account the amount the person should have received, had the award been correctly assessed. HMRC call this process ‘offsetting notional entitlement’.

For example, if someone was paid £5,000 in tax credits on their original claim as a lone parent, the whole of this amount may be considered as an overpayment if they are subject to a compliance check and found to have been paid the wrong amount. However, if they are entitled to £3,000 on their new claim as part of a couple, the overpayment can be reduced to £2,000.

HMRC guidance says that offsetting notional entitlement should be possible in most cases, except when HMRC believe the claimant was deliberately dishonest.

It is very important to make sure that HMRC do consider offsetting notional entitlement when appropriate, as the difference between the amount overpaid and notional entitlement may be comparatively small. However if offsetting of notional entitlement is not allowed, all tax credits paid from the incorrect award will need to be paid back.
