Equifax Have Not Removed IVA from my File

This is the letter I sent:

Data Controller

Dear Sir / Madam,

I am writing with reference to my credit report reference: xxxxxxxxxxx. After consultation with the Information Commissioners Office I am writing to request data on my credit file be amended in line with the Data Protection Act.

The Notice of Correction section notes: “IVA DATED xxxxxx WAS REMOVED FROM THE INSOLVENCY SERVICE RECORDS ON xxxxxx. ADDED BY IVABKYD ON xxxxxxx”.

I hereby request that this Notice of Correction is removed for the following reasons:
• The data on this notice of correction is already recorded on my credit file in the section marked Court Information and other public records. Placing it under the notice of correction section is an unnecessary duplication.
• As the IVA has been successfully completed after 6 years from the date of my IVA commencement this record will automatically be removed from my file. The notice of correction will not be removed automatically meaning that out of date data will be retained on my Equifax file. Under Principle 5 of the Data Protection Principles I am entitled to request its removal: “Personal data processed for any purpose or purposes shall not be kept for longer than is necessary for that purpose or those purposes.”
• This notice of correction will prevent automated credit checks from taking place – something that I do not wish to happen.
I therefore request the removal of this notice of correction within 28 days or an explanation as to why you will not remove it so that the matter may be referred to the Information Commissioners Office for a ruling.
Enclosed is a copy of the relevant Equifax credit file information. I look forward to hearing from you.

I found Equifax the most efficient and best CRA to deal with, I think it boils down to individual experience.

Thanks guys that's really great information. I only raised one dispute and put both the errors on there. Hope that's ok. Do you think I should also send a hard copy letter to them as well or do you think the online dispute is enough?

Online dispute may be enough but if not send in the letter if you get no response.

The website is b***** marvelous - just as much help after the IVA has completed as it was before and during...

I too have just sent my request to have the Notice of Correction removed from the Equifax report...

IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Good luck - I found Equifax to be a complete nightmare with their foreign call centre and staff that can't cope if you deviate from the script! If you don't have any luck with the online dispute you can call 0870 240 1170 and get through to a UK call centre - they removed the notice of correction from my file straight away.

I can not stress enough the importance of checking all 3 of the CRA.
Experian was clear after the 6 year mark, I was not shown as being on the electrol roll but one phone call and it was rectified.

Equifax also showed me as not on the electrol roll and an online dispute failed to remedy this, I have followed this up with a phone call and have been promised that this will be updated within 7 days.

Call Credit/ Noodle were showing that I was in an IVA at the 7 year mark which was technically correct as I had at that time not recieved a completion certificate. As soon as as was in receipt of this and also off the Insolveny register I raised a dispute. This was updated within a week
7 years after starting an IVA I finally received a completion certificate from ClearDebt

Great advice above!

Finally got Equafax to remove the NoC from my file (which I didn't know about initially) - this never showed up on the Experian report...
