Hi,
I am trying to find the best solution and i am so confused...
Me and my partner own a flat (with a joint mortgage)and we have two little kids together (5yrs old & 18 month old). We been having realationship problems for a very long time now and i am really considering about finally leaving him (even that breaks my heart as i`ve tryed to make it work so many times). The problem is that i have just started my IVA in March 2013 and we are not allowed to sell or re-mortgage our flat which is fine. I just want to find out if it`s possible to keep the flat and he can live there as i wouldn`t mind to move out with the kids. Just wandering if i would get any help towards renting a place for me and kiddies ( i do work full time at the moment but would like to work part time, like 9-3 every day...to take care of my kids). i have never been on any sort of benefits but now i am just trying to find the best way for me and my kiddies... Please help...I don`t even know where to go for advice [:(]

Hi There

A pretty tough time for you both now I imagine and also two kiddies, who perhaps have very little say in what you do as you both chose for them. Debt is a disease which tears couple and families apart, you either fight it together head on or let it divide you. If you have just started an IVA the road ahead will be a difficult one, and it will be the love between you that sees it through. As for the flat you can of course do what you like with it, its just that your IP will want a say in that. Without knowing your circumstances of what your flat is worth and what part of it you own my contribution to your situation is very limited, however I wish you all the luck and maybe others can be more help.

Hi,
Thanks, it is a very difficult desision to make... The flat is half his and half mine. And i am with debt Free Direct...So far they have been very helpfull...This is all sooooo hard!....I am just so scared to lose everything as we both worked so hard for it and this flat was our dream come through...I can`t stop blaming myself for all the debts i have, it is all my fault!

If breaking up is what you need to do then there will be a way forward that wont harm your IVA. Is it just in your name even though the flat is in joint names?

IVA is just in my name. It`s nothing to do with him.
