I received one of these letters about 4 weeks ago & from what i can make out gt wont close my iva until i sign & return this form, I am absolutely sick of these people, I told them in feb 2012 i would have to stop paying my IVA as i had had an accident & had to leave work & couldn't afford to pay it any longer, my mum god bless her paid a solicitor to help with all the paperwork i needed to go BR.GT have dragged their feet for nearly 1 year by still sending me I&E reviews,last week i had 3-4 phone calls every day from 0161 & 0141 phone numbers who i suspect are in cahoots with GT re this letter, this morning i got a txt from GT stating you must contact GT urgently, I haven't signed anything & i am not answering any calls as i am v unhappy with the whole situation, My solicitor cannot move forward with my BR until they hear from GT that my IVA has been closed, I feel GT are blackmailing me, "we wont close the IVA until you sign & return this form," it's not fair & my poor mum is getting no reward for the money she paid to try & help me.When i started my IVA i thought GT were great, not any more i'm afraid,they were happy to take money for fees etc out of my payments i made but now trying to get rid of them is like a bad smell that won't go away!!I'm sorry i have gone on a bit re this but i am so fed up & now v stressed & unwell with all this[:(].
Hi Holly --- have a word with the court who will be dealing with the BR petition. I have seen, in the past, a BR application go forward without formal notification of failure of an IVA ( again due to the IP dragging things out). The court will be able to advise.

If you sign and return the form then GT will chase all your past creditors to see if you are owed any PPI or unfair bank charges, If you went BR wouldn't the official receiver take over and GT would not be able to make any claims on your behalf?
There is nothing to stop you making your bankruptcy application, regardless of the fact that you have a failing IVA. Make the application, and draw this to the attention of the Judge on the day. Even if he won't grant an order there and then, he will probably write to your IP giving them 14 days to provide you with a Certificate of Termination. PPI mis-selling claims can still be pursued, regardless of whether the IVA is open or closed.
Thanks guys for your advice re GT letter but my solicitor says they can't do anything regarding the bankruptcy application until they hear back from GT, that is why my mum paid for a solicitor so that i wouldn't have the ordeal of going to court, my solicitor would go on my behalf, nothing is being done & it's nearly 11 months on, i'm severly depressed due to bad health & i don't know how much longer i can go on with this situation, Grant Thornton have me hanging by a thread & won't let go & iv'e had enough, why go on?[:(]
