I have been in my IVA since April 2009 never missed a payment. Recently I applied for another job in Financial services (which I have worked in for 15 years)and declared the IVA straight away and was told that it was not a problem as long as was up to date. Got the job but then the credit check from Experian showed the IVA as suspended - which it is not. I confirmed via bank statements and IVA company confirming up to date and even insolvency service confirmed status current. But job offer was withdrawn. Experian have told me suspended is the term they use whilst IVA is still being paid but Security watchdog the company doing the checking say the only ever see this term when an IVA has failed - this was what was communivated to the company who offer me the job. I ahd handed in my notice on my 15 year job and now I am temping. Experian will not update my credit file despite having had a request to do so from the Insolvency service stating it should show as current. My problem is that untile it shows as current all employers deem it to have failed and will not offer me a job - Any ideas I have been trying to resolve since Feb when I was first aware of it. It only shows on my corporate search not on my personal file so I would have never known it was even there. I am so frustrated and my IVA company have even written to them but nothing makes any difference.

Hi and welcome to the forum. I am sorry to read of this and was not aware of this before. Hopefully one of our experts will be along with an idea of how this may be resolved. Would Security watchdog accept a letter from your IP confirming everything is current and up to date?
IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Thank you for your reply. I have sent a letter from my IP to confirm payments are up to date and I have sent a years worth of bank statements to show payment going out. I have had the Insolvency Registrar contact them and confirm it is current and up to date. I am at a total loss what I can do now. Experian have given me so many different versions of events regarding my credit file, all I know is that whenever a check check is done on my I will fail even though the companies are telling my IVA is not causing a problem its the fact its showing as suspended and this to them means it has failed. Its just so frustrating I have been told I am high risk as it is suspended but I have never missed a payment and my mortgage is up to date and I declared it before my interview. I don't know what more I can do.

The credit referencing agencies are just not good at reporting on insolvency cases or debt compromise agreements, and if you cannot get them to change the status then perhaps a complaint to the Financial Ombudsman is in order, with a claim for damages for the lost salary as a result of their ineptitude.

Know the feeling with respect to a lost job opportunity due to not receiving certificate despite last payment being August 2012.

I am guessing I have no chance of claiming damages?

Only if you can prove that you have been directly wronged Geordie, and I don't think that is necessarily the case in your case.

Hi Rachel.01 I am sorry to hear about your situation. This is not acceptable. I would employ a good solicitor and take Experian to court and sue them for loss of future earnings and legal costs. They are reporting incorrect information and as such you would come under the protection offered by the Data Commissioner.
