How long can DFD keep me waiting for certificate

I am concerned with DFD for this reason mine ends soon to im dreadin prolonged agony :-(

well after i refused to do my ppi claim after the horror stories on here dfd offered me a variation meeting, but to get this meeting you have to sign an agreement which states that your give your ppi to them after youve already recieved you CC, i figured this was a rue to get me to sign the papers, how would i know that they held the meeting and didnt infact just say they had giving me the bad news of :oh sorry you cant do that now and you have to wait for your ppi claims to come back" then taking even longer to recieve my CC, so i asked for a representative at the variation meeting, it was as if id asked for the devil to be there, i need to provide a whole host of things, iv accumulated a great deal of eveidence in emails and letters so i also asked that i see how much dfd actually paid to my creditors out of the large amounts of money i paid them each month, low and behold iv not heard a peep from them!! theyve gone from houdning me to do this equity finance ppi claim to nothing. a ppi claim i might add that they take 100% of, i tell you i wish id gone bankrupt 4 years ago, id of been far better off than paying into an iva with dfd. nothing but hassle, i asked for a variation meeting to be held before i sign any papers and they refused to do this, why? i want my CC which im due, and im not willing to wait another few month maybe even a year to get it. when they want somthing there on you like a shot, when you want somthing they ignore and go quiet.

am i right in hearing that you can only be kept on the insolvency list for a maximum of 6 years, after that time has lapsed your taken off the register?

Hi 636177560. You will be kept on the Insolvency Register for as long as the IVA is open -- be that 6 years or 16 ! If the IVA is closed ( by the issue of a completion certificate ) within the 6 years from the start date, then, yes, is does drop off your records around the 6th anniversary.

With regard to PPI, it is in your interests to comply with DFD, however annoying, as they will not issue the certificate until they have investigated PPI and paid any refunds due into the IVA.

As for you attending the variation meeting ... it isn't usually a physical meeting. The creditors are served with the papers and vote, by the time set for the "meeting" by post, fax or email. So, if you did attend, you would most probably be sat alone in an empty room.

really even though your only bound to the iva for 5 years?? dont you sign an agreement which states that after 5 years your iva will be concluded?

Yes, you sign an agreement for 5 years ( sometimes 6), but that agreement has clauses in it allowing it to be extended in certain circumstances. As long as it is within the terms of the agreement it can be extended. You also sign to agree to comply with instructions from your IP for the better running of your IVA and to allow him to maximise the return to the creditors --- even after you have made the 60 agreed payments refusal to comply with PPI investigations could see the IVA being failed, as you are effectively denying access to an asset which is considered part of the IVA proceeds.

ok thank you for that, also why when i asked dfd to see records of payments that have been made to creditors each months have they suddenly stopped all correspondance? i asked to see as i was paying large amounts each months and i wanted to see how much creditors actually got given. surely im privvy to this information what with it being my case? many thanks

Hi, yes, they should provide you with detailed accounts if you want them, after all, it is YOUR IVA and YOUR money they are dealing with.
