Hi, I completed my IVA in November 2012, got my completion certificate about 1 month afterwards.
about two months before i completed, my IP's office called asking me to go through a PPI company of their choice to see if i could claim, I didn't think i would be entitled to anything due to my IVA.
Anyway, this week i've just heard that i'm due about £3000 refund. The PPI company have been contacting me directly about everything, there has been no mention of my IP company, they are also saying that I am liable for their costs. I don't know what to do...if i get the cheque through the post, i will have to use that money to pay the costs of the PPI company, it will then leave me with about £2000... do i just keep the rest of it safe incase i get chased for it? I don't know if im entitled to keep it now that the IVA is completed.
I would make contact with your IP, at least that way it's not going to come and bite you (either by spending money that isn't yours, or paying costs that you don't have to)
Firstly, you would have entered into a contract with the claims management company at the time you instructed them to act on your behalf with regard to PPI reclaims - so if this has been executed correctly you will need to pay their costs from the proceeds of the claim.
If it is deemed that the monies are an asset of the IVA, notwithstanding the fact that this has been closed the monies will be rightly payable to your IP for the benefit of the creditors who were included in the IVA. If this is the case, them the claims management company's costs will be paid by the IP.
