I'm not sure I agree with canaries, I don't see this problem going away (even when the IVA is finished).

The way I see it the longer you leave dealing with the issue the more guilty it could make you look.

Emma, whether you received bad advice or not regardless of how impossible your circumstances were at the time- my understanding is if you had savings then they should have gone to the creditors.

There is no win win situation in an iva. I don't mean for you to feel even worse than you do but really, there are hundreds of thousands of us who have been through an iva & who are going through an iva & can you imagine the kind of anarchy it would cause if we were all to try & hide savings ( if we had any that is) & not be totally honest to our creditors?

I think you are having a dilemma because you know you shouldn't have had that money stashed away in your house & if you wnt any chance of that money being recovered & come clean to the police ,you are worried about the implications to your iva.

Either way the money is gone.

Not quite correct, I have already come clean to the police, I am waiting to hear what they are going to do about it, if anything.

How did the burglar enter into your property Emma? Did they break in and cause damage to the property?

At least you can move forward with that now.

I really hope the situation resolves itself for you & I do hope the police find the thieves , stash of cash issue aside, your home has been invaded by criminals.
it must be a frightening thing to have someone come into your home & ransack it.

I am quite suprised you had 'several thousand pounds' at the start of your IVA to squirrel away, most of us use every last penny robbing Peter to pay Paul trying to keep afloast before we make the step towards an IVA.
Sorry maybe we haven't had all the information but something doesn't sound quite right here.

There are some really crooked IPs out there - before we settled on Melanie's team we contacted a company and didn't go with them due to the dodginess of some of the advice given regarding what to do if we had a windfall. Even to me it didn't sound right and I admit to being very slow when it comes to these things...

Dear PJ - I don't expect people to fully understand however I didn't expect to be judged so harshly either. I have worked a full time job since I was a teenager apart from when I had my daughters) and never claimed a penny in benefits, I have robbed peter to pay paul only to keep the wolves from the door and to try to help my husband who has suffered with a gambling addiction for 40 years. I have suffered shame and fear all this time and the only thing I had to hold onto was a small inheritance from my father who passed a few years ago. My parents were good old fashioned people who never borowed and saved for their old age. I'm not saying I did the clever thing, I did the human thing. I came here because I scared and desperate and needed some good advice. If you have nothing helpful to say then please keep your opinions to yourself. I'm not looking for idle reassurances either, just someone who lives in the real world that might have had similar experiences, or an expert that can shed some realistic light on this issue. Thanks to those that have done this so far...

Dont worry about being judged, its a public forum and all opinions will be aired, we dont always agree on things.

your ip being involved is irrelevant as they wont have been daft enough to tell you in writing to hide assets.

I cant imagine it being in the public interest for the cps to waste time and money on prosecuting but equally I cannot imagine your home insurers paying out a claim where you cannot prove whats been lost.

I doubt, at this stage, the police will be interested in anything IVA related.

First you need to deal with the burglary and see what can be recovered and what the insurance company will replace.

If they reimburse the cash loss, then that will be the time to sort out what to do with it in regard to your IVA. Bottom line is probably going to be that the creditors will want it paid into the pot, for the benefit of the IVA.

But, take things one step at a time and try not to let your imagination get ahead of itself.
