IVA final payment left the bank on the 26th January 2013...looking forward to a debt free future.

Hi Michael,

Just read the chairman's report under heading, duration.
It say's it is proposed that the voluntary arrangement should last for 5 year's from the date of the creditors meeting. In that period of time it is anticipated that the supervisor will have been able to realise all assets, agree all claims and make distributions to creditors but if for any reason the supervisor requires to prolong the arrangement then he shall have the power so to do for such period as he's sees fit.

Does this mean they can keep my IVA going on forever, even though I have been exemplary through out the 5 years ?

I'm starting to get a bit disappointed with my IP.

If it is in the Chairman's Report it is more likely to be a suggestion of the creditors rather than the IP.

That gives the supervisor a lot of discretion which surprises me. Normally three months extension is fine and any longer needs approval of creditors.

I am compiling an email to my IP at present, I will cut and paste to show all.
when this is all finished, I think I may have a lot of experience to offer this forum and would like to become a voluntary mentor in the future.

Just writing a letter now,
Dear Kayleigh

I have just read the chairman’s report in view of our case, even IVA experts can’t believe how open ended this is, as usually 63 month’s is the longest you can be in an IVA.

Therefore, it looks like I have to abide by these conditions, conditions I would not have agreed to when starting this arrangement, should I have known this outcome.
I do have a few questions though,
Firstly can I ask, have you any complaints regarding our correspondence, honesty, Integrity and commitment to our situation and this 5 year agreement?
Question 1, what is the hold up??
Why did it take me to phone you on the last day of our 3 month extension to find out YOU have decided to increase this extension for a further 3 months? (Wrongly I thought) that Beasley was working on our behalf.
Question 2,
When do we get our F&F notification? When do we get our release certificate?
Does, keep putting back our IVA agreement, keep putting our 12 month release anniversary back?
Question 3,
Is there anything outstanding that I can sort out?
I always phone you to ask what I need to do, you don’t communicate with me! You said you would email Friday to explain why we have to take another 3 month extension, no email, WHAT IS HAPPENING PLEASE?
I am a man of 56, my pride left me nearly 6 years ago, I want it back now!
If something is holding this back, please let me know, who, what, when and how.... PLEASE
I don’t want to take this to a formal complaint, but I do want closure now.

Think I have a lot to offer for people who are going through the worst time in there lives.

What you could do Kev is write a blog if you wouldn't mind, they're very helpful to a lot of people. Write down your experiences and how life was for you in an IVA. Also a chance to win blog of the month which I believe is a £100 if you're chosen.
