oh god!! I feel physically sick after reading that we have sent all our review stuff they emailed me yesterday to say our review would be conducted once they receive our bank statements if the outcome is bad I think we will HAVE to fail our IVA devastated as really felt like we were getting our lives back under control after many years of debt.My health and well being wont stand another 3+ years I don't think :(

I don't understand why they moan about the forum and "misinformation" and yet when you ask them to post something that isn't misinformation they are entirely reluctant to do so. It defies logic

This is an awful position to be in. Feel powerless and vulnerable. Our review is April and im more nervous than i was pre-iva about our financial position. Savings from our share of overtime is not theirs to take. Savings from a weeks shopping which cost less is not an asset. I just want out.

My review should have been in December, I am seriously considering just doing a review based on the info I used to send to Mel and email them it across.
We currently having money in a savings account waiting to see whats happening to is, another query waiting to be answered from last October.

QUESTION???

If you have 'savings' but hold it in a current account, does it then become savings, or just money waiting to be spent. Maybe savings implies money with no purpose to it as yet.

Would be interested to hear what any experts think, plus you good people.

I think they have a blinkered view that anything put on one side is spare cash and they cannot see that it is being accumulated for a big bill that will come up in the future (like 1000+ litres of heating oil).
They have not worked out that it is not "silly money" that will get wasted on something fun rather than something that has to be planned for.

Email customer services for them to email the I&E to you and sent 6 months wage slips/bank statements I have done this before they have requested it mine is due 25th Feb, They emailed back to say they are jut waiting to receive my bank statements in the post then they will conduct my review

Our review was supposed to be December too, i called them and asked when it is going to take place and was told there was a 'large' backlog of cases to review and when they were ready to deal with mine and my husbands they would contact us!

Like everyone else i am absolutely dreading it.

It is irrelevant where the money is as it does not belong to your IP. It is your allowances, money to pay future tax bills, your share of overtime etc and whether you want to spend this or keep it in the bank is entirely up to you.

If someone wants to save their share of allowances, overtime etc to go on holiday that is their right but this seems to be disallowed. However if someone decides to drink or gamble their share then that is fine as they would no longer have the funds. Ludicrous.

What can we do about that though michael? What if they double/treble the monthly payments even if theres no change to income but they see 'extra' money on peoples bank statements? Mel gave her clients allowances within guidelines but it seems CF have their own rules and will not be as lenient/realistic as mel was. That money would not be theirs.

Bank statements in the post? Does that mean you had to get official ones, do they not accept PDF downloads of them.

Starbuck: We too are both in the IVA and I've been getting so wound up about it. We did try in OCtober to get a question answered from PGJ about some money we got for damages, but its standing in a bank account waiting for an answer....which obv should now be CF. I am loath to ring them because I really can't handle what they might throw at us.

I'm inclined to just let it all run its course. But we are in yr 5 now, so should be doing the PPI and Equity thing soon, but no clue where or how.

Michael, I agree completely what you are saying, but from our point of view, if CF turn round and say, that money has been sitting in your account for x months, we want it....how do we say No, without it causing a fail. We are in the position of not being able to answer back or defend ourselves without running the risk of further problems.

HOW would we say to them, no its not yours, its ours that we have put away for contingency and you can't have it??

Yes PDF downloads will be fine I bank with Yorkshire bank and they do not provide Historic online bank statements so had to copy the originals and post, I think we all need to be pro-active get your stuff sent off then you have completed your side of it in a timely manner when they decided to deal with it is down to them

It's a real worry Bereaved, with the allowances we had at PJG our situation was certainly liveable, we managed to have a decent Christmas and gave the kids pressies, able to replace a tumble dryer that went bang without taking a payment break and just thought we were being responsible in trying to put by a little for a rainy day should it come.

I have not seen the I&E CF form so no idea what you can/can't claim for.

My husband also earns overtime most months, pays his chunk into his IVA and the rest we use for things in the month if we need to or put it up for if and when we need to replace something. If CF are saying they now want ALL of this i think that is extremely unfair.

I don't see anyway they can take any shares of uplift/bonus/overtime ect I really don't think they would be able to do it, it is clearly explained in proposals how uplift is dealt with as long as you are paying their share over they cant take anymore of it
