Just looking for some advice really.
If I write a complaint to my iva company about the way they have treated my case since it moved to them, would I be being stupid because they are likely to make things more difficult for me?
Specifically, the lack of response from them despite my chasing and the fact they have now put me in arrears because they closed the bank account my payment went to, without telling me. And then told me if I didn't make up the shortfall straightaway (I've just had the month from hell with desperate work needed on cars to get us to and from work) they would call a meeting of the creditors and tell them I was in arrears, all the time speaking to me like I was a liar and a piece of dirt.
Thoughts anyone?
The general experience seems to be that these are template letters they send and the actual staff, when you speak to them, are very sympathetic and helpful. A complaint should not produce any bad service ( if it did then you would complain to their regulatory body).
My opinions are merely that .. opinions based on experience. Always seek professional advice.
IVA Completed 23rd July 2013 .... C.C. 10th January 2014
Thank you Foggy.
I spoke to 2 people who were really nice, one of them left me a voicemail saying don't worry, we'll get this sorted, and asking me to ring him back. When I did he was away from his desk and I spoke to another man who was obnoxious, telling me he would call a meeting of my creditors to tell them I was in arrears and then it would be up to them what to do. When I said hang on, this payment left my bank ok, he told me it couldn't have and I was wrong.
I was so upset I contacted my bank who investigated and found that the reason it was returned was that the iva company had closed the account I paid into.
To say I'm unhappy is an understatement.
When I asked the iva company before I contacted my bank if the account could have been closed in error, mr obnoxious answered no, of course not, the payment couldn't have left your bank.
That on top of waiting 5 months for any action from them, even tho I've chased and chased, leaves me feeling annoyed. But I am worried if I complain they will be even more awkward and unhelpful than some of them are already.
The helpful ones are lovely and friendly but some of the staff really let them down as a company and they are the ones you remember.
Im sure that any arrears will be able to be capped on the end of your IVA when its all sorted out. The creditors are usually supportive from my experience and I can't see a problem. At the end of the day its in their best interests - as well as yours - that you are able to pay within your budget. Hope you get things back on track again swiftly.
Im assuming this is our friends at CF?Did you get the name of the helpful person? Call back and ask to speak to them. Did you get name of Mr Obnoxious? If it is CF, they sent out a delightful letter in Dec/Jan about closing the account we used when with Mel and we had to transfer payment into a RBS account. I have very little trust in them and prefer to communicate via email so I have everything in writing and who its from saved/evidenced so they cant deny whats been told to me. Hope you get this sorted. If its only a payment or 2 which got missed due to change in account surely you can tag an extra payment on to the end.
It's only 1 payment, it seems they closed the account sometime during December so the January payment bounced back and then they emailed and wrote on 19 January to say they were going to close the accounts and move to rbs. So I had no chance of changing for the payment on 1 January!! Have already paid half of it and will pay the other half at beginning of may but it has really upset me. Up to now I have had no issues, everything paid on time and right at the end of the original 6 years it goes wrong. I know I should have picked up that the payment bounced back but I've been working 7 days a week, 15 plus hours a day since Christmas and I just missed it. Had they left the account alone, or told me it was closed before my payment rather than 17 days after my payment, there would have been no issue. Grrrr!
