I am getting confused here ---- are these savings made from your allowances and share of overtime etc, or did you have a sum stashed away before going into the IVA ?

As for the insurance settlement -- I would take this to their regulators.

Only way that I can see a car being defined as an asset is if it was top of the range and you were getting a high 4 to 5 figure sum.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.

Hi

No I had no money stashed away I saved it from my monthly pay and overtime etc

It was not a top of the range car either

The crazy thing is a couple of years ago before I brought the car when I was in my Iva they gave me permission in writing to get a car on a finance agreement for over 10k
I didn't go ahead with it carried on saving and brought one meaning not getting myself into debt and now they want it all

They new you had a car because the insurance would be on your I&E every year?

You need to try and speak directly to your IP.

Yes I have spoken to them and they ain't budging apparently I should have told them

The inurqnce company have been instructed by the insurance ombudsman to settle by end of month to me plus compensation and interest
Since then they have decided to discuss everything with my even settlement offers behind my back
I am at my wits end with it all just want it all over now as it is affecting my family life now :(

Do you mind saying roughly what level of savings you had and value of car insurance payment?

That might help some of the IP's who contribute to give some advice.

As well as a complaint to their regulators, I would have a word with the data controller of the insurance company for discussing your private insurance business with an unauthorised third party.

At your last review did you not claim for petrol, insurance and running costs for a car? Really do not see how they can claim the money if it was out of your share of money when they have had their share. If you had used it for a holiday they wouldn't have had it or if you had stashed the cash.

Don't let it drop. Have you spoken to your actual IP?

Based on a post that was quickly deleted (unless I fantasised it) I can see why the ip is challenging and taking the stance that they are.

I do not recall any other post. Issue with forums are the replies are only as valid as the posts! I thought a car had been brought from savings from posters share of overtime. Car was insured, insurance payout due but IP wanted it. That's what my replies are based on!!

I can't understand the IP'S stance on it as it has been put forward on here
if so there is no point in any of us having insurance while in an IVA! House car or any!

I thought that for the house insurance too. If we had have had a fire that destroyed our house, would they have taken all our building and contents insurance money? Something doesn't seem right somewhere.
