My IVA payments were completed April 2014 but due to IP chasing up PPI's I was told they could not issue me my completion certificate. The latest contact I had with them when chasing it up, I was told that one of the creditors had kept the PPI (amount £150) which means that they have been overpaid and could not close my IVA.
I have sent in a complaint and the response is that they partially uphold my complaint because I have not been kept informed but feel when I have spoken to the office I have been given the reason. But because of still waiting for this money back from a creditor they cannot close my IVA. They also cannot issue Deed of Assignment as they would have to create a Trust which is not in line with their company procedure.
They hope to get the money back so they can complete my IVA, but if not they will present a proposal to all the IVA creditors explaining the situation and asking for the supervisor to be allowed to close the IVA.
They do not give me a timescale and I feel that this could go on and on.
Any advice please on my next steps.

For the sake of £150 I'm not sure they are seeing the wood for the trees - it would cost £500 to call a creditors meeting.
I would complain plus to be honest if I had £150 available I would send it to them and say that I was prepared to pay the difference.
IVA started March 2011, Completed March 2016 and certificate issued 11 days after final payment. It was not always easy but then some of the best decisions aren't.
Thanks both. Yes I was thinking the same to offer them the £150 and demand that I then get the certificate within two weeks and my name off the insolvency register within a month.
We are wanting to move house as the house we are in is starting to cost us money and the whole idea of having an IVA is to be come debt free - which is why I am so frustrated.
Do any IP's on here think my offer of the £150 would work (although I would still be annoyed at the company for not sorting this out themselves). Thanks janjan
Make the offer but at the same time formally complain - this is not typical and therefore they would have to demonstrate that what they are doing is in line with industry practice given the amount involved.
I would also argue that once their fees are taken out the £150 would be far less than that anyway.

I am emailing them and copying in the IP (who I have never been able to speak to), offering the money but only if they guarantee to remove my name off the insolvency register four weeks after receiving my money. Will keep you updated. Thanks janjan
Unfortunately janjan your name coming off the register is down to the Insolvency Service and not your IP - some come off very quickly but others can take up to three months.

I'm not sure - as far as I am aware the IP just lets the service know you have completed. Some people (including myself) came off within a couple of weeks, others (Foggy is one) was told it would take the full three months and nothing he said would persuade them otherwise.

Thanks. I will include in my letter that the IP asks the Insolvency Register to remove my name asap. At least if they do that I would believe that they did want me to complete the IVA, whereas at the moment I feel that they just want to keep me in the IVA incase they can get more money out of me. Thought I would give you all an update. After waiting two weeks for a reply to my offer to pay the £158 I decided to phone them and speak to the manager who I had emailed. Cut a long story short he came on the phone and said he was just about to message me as they have now received an email confirming that they will get the money back from the company who had been overpaid. Apparently I would not have been able to pay this money as it would go against procedures. He has said that he will now ensure that the closing of my IVA is started and he hopes I can have my certificate within the next two weeks. He does not want my final dealings with the company to be negative he would rather is was positive. Fingers crossed. I will of course be back on the phone if I have not heard anything in another two weeks. janjan
