just had a look and it would seem Mrs Longslog and I have dropped off the register 3 months to the date of completion, excellent, everything is private again.....
I still continue my structured argument that the CRA now have no right to list my IVA on my credit report because it is on the report in the "public records" section and obviously there is now no longer any public record.
The ICO responded to me stating they have checked with the CRA's and yes they keep it on file for 6 years, the lady there didn't really seem to grasp that just because they do it, doesn't mean it is allowed, she also said your record is accurate because it says complete, again missing the point that even if it says complete on the credit report it shouldn't be listed in a public report if there is no public report available.,so this has been escalated as a complaint and for a further review in the ICO.
I have also written to the Secretary of state asking for specifics about the "legitimate interests" argument used by the CRA for keeping it on my file, as I do not believe the CRA's have undertaken the balancing exercise required to use this justification (historical defaults on credit file would achieve the same outcome for any person requesting a credit check).
I will let you know if and when I get a further reply from the ICO or reply from the SOS, so far nothing,.....
My argument had all been hypothetical based thus far, now that the IVA is no longer in the public domain I can now request my statutory reports and then formally lodge complaint if it remains on my credit file as a public record.
